This open access book can be downloaded from link.springer.com Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics. Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processes became palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. This book throws light on the relevance and role played by translations and translators at times of serious discontinuity throughout history. Topics explored by scholars from different continents and disciplines include war, the disintegration of transnational polities, health disasters and revolutions - be they political, social, cultural and/or technological. Surprisingly little is known, for example, about the role that translated constitutions had in instigating and in shaping political crises at both a local and global level, and how these events had an effect on translations themselves. Similarly, the role that translations played as instruments for either building or undermining empires, and the extent to which interpreters could ease or hamper negotiations and foster new national identities has not been adequately acknowledged. This book addresses all these issues, among others, through twelve studies focused not just on texts but also on instances of verbal and non-verbal communications in a range of languages from around the world. COLIN KIDD Awarded the Senior Hume Brown Prize 2010 The passing of the 'Great Reform Act' of 1832 retains a central place in British history. Historical debate, however, has focussed on whether reform represented the end of the ancien régime or a conservative holding action by political elites. Little critical thinking has been devoted to investigating the passage of the three different Reform Acts as a renegotiation of the relationship between England, Scotland and Ireland. By providing a history of reform in one national context this study addresses several key themes. It delivers a more 'British' history of reform, exploring how the constitutional crisis of 1828-32 was negotiated in different contexts and how, throughout the 1820s and 30s, events in England, Scotland and Ireland impacted on one another. It moves beyond constitutional questions to explore the development of a political culture of reform in shared languages, strategies and personnel across a number of political, religious and social reform campaigns. Finally, it argues that the period was crucial in the renegotiation of what it meant to be British and had a profound impact on national identities in Scotland, where different versions of Britishness and Scottishness were integral to the practice of politics at all levels.
