Houses of Multiple Occupation and Selective Licensing

Houses of Multiple Occupation and Selective Licensing PDF Author: Neli Borisova
Publisher: Taylor & Francis
ISBN: 1000817474
Category : Law
Languages : en
Pages : 128

Book Description
The aim of this book is to provide a comprehensive and up-to-date overview of the law relating to houses in multiple occupation (HMOs) in part 2 of the Housing Act 2004 that local authorities environmental health practitioners use to regulate this sector. This book emerged from a set of course notes developed for a course on HMO property but took on a life of its own as the law has become increasingly complex. The law on HMOs is constantly evolving as its practical and actual application and effect on landlords is heavily dependent on the way it is interpreted by the Tribunals. This book also addresses the 2016 Housing and Planning Act, includes up-to-date key cases, and discusses how they interpret and develop the law. It also explores the limits and weaknesses of the law and the competing interpretations of key passages to illustrate where the current debates are and how they might be resolved. This book is aimed at a professional audience spread across the housing sector with enough detail to satisfy experienced environmental health and other professionals and extensive footnotes to enable further research. Other officers - housing advisers, landlords, agents - who are newer to the subject of housing law will find this a detailed introduction to the basics.

Selective Licensing

Selective Licensing PDF Author: Paul Oatt
Publisher: Routledge
ISBN: 1000027120
Category : Technology & Engineering
Languages : en
Pages : 64

Book Description
In recent years, the private rented sector has overtaken social housing to become the main housing provider with some of the worse housing conditions that are linked to preventable health inequalities. This book seeks to expand upon previous research in the area with a focus on selective licensing and enforcement, using a case study to illustrate changes in working practices that have been bought about through new powers being made available to local authorities to issue civil financial penalties upon criminal landlords. The book examines the impact of this legislation on regulatory enforcement in the London Borough of Newham’s property licensing scheme, delivered in a multi-agency partnership across its private rented sector, and the outcomes of combining the use of licensing and traditional housing inspections with use of civil penalties in alternative to prosecution to address some of the worse effects of poor housing. The study also considers the limitations of employing informal actions to address such issues as well as identifying both the barriers to collaboration and the most effective strategies for service delivery where agencies – such as the police, border agency, council tax and local planning, irrespective of inter-agency competition – work together to achieve individual and shared objectives in evolving partnerships. The findings here will be of keen interest to environmental health professionals, academics, and indeed those operating in local authorities themselves.

Housing

Housing PDF Author: Great Britain. Law Commission
Publisher: The Stationery Office
ISBN: 9780101745628
Category : Law
Languages : en
Pages : 140

Book Description
This report completes the Law Commission's programme of work on the reform and modernisation of housing law and practice. Earlier reports were (1) "Renting homes" (Law Com. 297, Cm. 6781, ISBN 9780101678124) and (2) "Housing: proportionate dispute resolution (Law Com. 309, Cm. 7377, ISBN 9780101737722). The focus of this report is the private rented sector, specifically the repair and maintenance of the property and harassment and unlawful eviction. It builds on the consultation paper on this topic (2007, Consultation paper 181, ISBN 9780117037816). Part 1 sets out the background, and part 2 considers the case for change. Part 3 reviews the history of regulation. The options for change outlined in the discussion paper are rehearsed in part 4 and part 5 sets out the conclusions drawn by the Commission from the responses to that paper (which are detailed in appendix B). Part 6 sets out the recommendations for reform. The review offers the prospect of a new regulatory approach that will be of significant social benefit. Implementation of the recommendations in "Renting homes" would contribute to the understanding of both landlords and occupiers of their mutual legal rights and responsibilities and encourage responsible renting. Smart regulation is proposed, involving much greater self-regulation by the sector, the establishment of housing standards monitors and codes of practice for housing management practice and letting agents. The recommendations set out a series of affordable and proportionate measures that, by enhancing self-regulation, will improve the management of the private rented sector.
