The bill contains measures which were passed by the House of Lords in the last session of Parliament (in Lord Steel of Aikwood's House of Lords (Cessation of Membership) Bill [HL]; although the precise wording of the two bills differs in some particulars). The bill provides for three "small-scale" reforms of the House of Lords.5 6. First, in clause 1 the bill provides for the resignation or retirement of members of the House of Lords. Under clause 1 resignation may not be rescinded. Secondly, in clause 2 the bill provides that a member of the House of Lords who does not attend during a session ceases to be a member from the beginning of the following session. Exceptions are provided for, for example where the session is short, where the member has leave of absence or where the House resolves that there are "special circumstances". Thirdly, clause 3 provides that a member of the House of Lords who is convicted of an offence and sentenced to be imprisoned for more than one year ceases to be a member of the House. This applies to a conviction outside the United Kingdom only if the House of Lords resolves as such. The bill is clearly a measure of constitutional reform but, in the Committee's view, it raises no problems of constitutional concern

The European Court of Human Rights has described the UK's current blanket ban on prisoner voting as 'general, automatic and indiscriminate' and found it to be in breach of article 3 of protocol 1 of the European Convention on Human Rights. The ECHR requires the UK to bring forward legislative proposals to amend our current legislation to be compliant with the Convention. The Government is putting forward three options to a Committee of both Houses for full Parliamentary scrutiny. The three options are: a ban for prisoners sentenced to 4 years or more; a ban for prisoners sentenced to more than 6 months; a continued ban for all convicted prisoners. When the Joint Committee has finished its scrutiny the Government will reflect on its recommendations it will continue the legislative process by introducing a Bill.

The report The Implications For Access To Justice Of The Government's Proposals To Reform Legal Aid (HL100, HC 766) concludes that the government should reconsider its proposals for the reform of legal aid. The government has so far made welcome exemptions to its proposed residence test in the light of responses to its consultation, but the Committee is still not satisfied that the proposed test will not affect vulnerable groups. While accepting that it is legitimate for the government to introduce a residence test for civil legal aid and to restrict the scope of prison law funding, the Committee calls for more and broader exemptions from these proposals to avoid breaches of the fundamental right of effective access to justice in individual cases.
