[...] En plus de l'autorité constitutionnelle du gouvernement fédéral et des lois existantes, les traités numérotés conclus de 1871 à 1910 imposent à la Couronne fédérale de maintenir des écoles et de fournir des services pédagogiques aux Premières nations signataires dans le cadre de ses obligations conventionnelles permanentes17. [...] Les articles 114 à 122 de la Loi sur les Indiens permettent au ministre des Affaires indiennes et du Développement du Nord d'« établir, diriger et entretenir des écoles pour les enfants indiens ». Cependant, les dispositions de la Loi portant sur l'éducation traitent grandement de l'absentéisme scolaire et ne font aucune référence aux questions de fond en matière d'éducation ou à la qualité de l'é [...] Il importe de le souligner, l'évaluation ministérielle reconnaît que la responsabilité des Premières nations en matière d'éducation a été restreinte et que « faute de capacités et de ressources appropriées, de nombreuses collectivités ne sont pas en mesure de maximiser l'incidence que la prise en charge de leur éducation par les Premières nations peut avoir dans un domaine aussi fondamental que l' [...] Notamment, en vertu de l'article 16 de la CBJNQ, les Cris ont pris le contrôle de leur éducation, y compris en ce qui concerne la possibilité de choisir la langue d'enseignement, la conception des programmes d'études, l'embauche des enseignants et l'établissement d'un calendrier scolaire cri - ce dernier permettant aux jeunes Cris de participer à des activités de chasse et de pêche traditionnelles.

As First Nations and Canada mark the 250th anniversary of the Proclamation of 1763 and the fifth anniversary of the Prime Minister's historic apology to former Indian Residential School students, the Government of Canada has committed to working with First Nations to develop a First Nations Education Act to support improved quality of education and better results for First Nation students on-reserve. This is the result of a number of efforts by First Nations following the path set out the 1972 AFN/National Indian Brotherhood paper Indian Control of Indian Education , through joint efforts such as the Canada-First Nation Joint Action Plan, the National Panel on Elementary and Secondary Education on Reserve, and the Crown-First Nations Gathering Outcome Statement, and Government of Canada reports such as those from the Office of the Auditor General and from the Standing Senate Committee on Aboriginal Peoples.
