Book Description
Advocating a style of law and a role for legal agency which returns to its essential humanist ideology and represents public spiritedness, this unique book confronts the myths surrounding globalisation, advancing the role for law as a change agent unburdened from its current market functionality. Mark Findlay argues that law has a new and urgent relevance to confront the absence of resilience in self-determined market places, and to make coherent the anarchic forces which are running, and ruining the world. The inevitability of law's re-invention during global crises is considered, offering a critical evaluation of the future of legal agency, service delivery and access to justice. Chapters also engage with citizen-centric surveillance society to examine the dangers to personal data, individual integrity, and work-life quality from unregulated mass data sharing. Exciting and thought-provoking, this book will be critical reading for scholars and students in law, economics and governance interested in globalisation and crises, such as pandemics, as well as populist politics and anxiety governance.

A Pandemic of Populists

A Pandemic of Populists PDF Author: Wojciech Sadurski
Publisher: Cambridge University Press
ISBN: 1009224514
Category : Law
Languages : en
Pages : 259

Book Description
Over the last decade, the world has watched in shock as populists swept to power in free elections. From Manila to Warsaw, Brasilia to Budapest, the populist tide has shattered illusions of an inexorable march to liberal democracy. Eschewing simplistic notions of a unified global populism, this book unpacks the diversity and plurality of populisms. It highlights the variety of constitutional and extraconstitutional strategies that populists have used to undermine the institutional fabric of liberal democracy and investigates how ruling populists responded to the Covid-19 crisis. Outlining the rise of populisms and their governing styles, Wojciech Sadurski focuses on what populists in power do, rather than what they say. Confronting one of the most pressing concerns of international politics, this book offers a vibrant, contemporary account of modern populisms and, significantly, considers what we can do to fight back.

Book Description
"This book presents an exploration of a wide range of issues in law, regulation and legal rights in the sectors of information protection, the creative economy and business activities following COVID-19. The debilitative effect of the global pandemic on information protection and creative and business activities is powerful, widespread and deeply influential, bringing a range of uncertainties to these sectors. The effects of the crisis challenge the fundamentals of the legal systems of most countries in their attempt to govern them. Written by international academics from a diversified background of law disciplines and legal systems, this book offers a global vision in exploring the wide range of legal issues caused by the COVID-19 crisis in these fields. The book is organised into three clear thematic parts: Part I looks at information protection and intellectual property rights and strategies; Part II examines contracts, cooperation and mediation in the post-COVID-19 market arena; and Part III discusses issues pertaining to corporate governance and employment rights"--

Against a Deconstitutionalisation of International Law in Times of Populism, Pandemic, and War

Against a Deconstitutionalisation of International Law in Times of Populism, Pandemic, and War PDF Author: Anne Peters
Publisher:
ISBN:
Category :
Languages : en
Pages : 0

Book Description
In the context of a power shift away from the Western world, disenchantment with globalisation, and the rise of post-colonialist and post-humanist thinking, global constitutionalism is under pressure. The factual acceptance and normative appeal of the constitutionalist 'trinity' of the rule of law, human rights, and democracy needs to be re-examined. Erosions and attacks concern all three principles, and also institutions that embody them such as the International Criminal Court and the regional human rights courts. However, constitutional fragments in the international legal order (in its interplay with domestic law) appear to be resilient, in the context of ongoing, though slowed-down globalisation. We perceive islands of constitutionalism and an ongoing constitutionalisation in international law such as the recent reform of the working methods of Security Council in the direction of transparency (with an obligation to give reasons for the exercise of the veto). The paper argues that global constitutionalism can and must be updated and adapted by addressing its colonial legacy and its Eurocentrism. It must accommodate cultural pluralism while insisting on a bottom line of universal values that should not be undercut. Global constitutionalism must also avoid double standards while properly distinguishing situations in law and fact. Finally, global constitutionalism needs to become more social by incorporating transnational social rights, strengthening investor obligations, further operationalising the international legal principle of transboundary solidarity, and acknowledging the nexus between the rule of law and development.

Populism, the Pandemic & Prospects for International Law

Populism, the Pandemic & Prospects for International Law PDF Author: Campbell A. McLachlan
Publisher:

Book Description
Populism has fatally weakened the world's ability to respond to COVID-19, by undermining the capacity of the structures and mechanisms of international law to address the pandemic. The pandemic has exposed as a fallacy a key tenet of populism - to protect the 'people' of a nation from external forces, including international law. In fact international law, through the principle of self-determination, enshrines the ability of peoples to determine their own political organization. But this does not preclude agreement at the international level on matters of common interest to humanity as a whole that require community action. The prevention of infectious disease is just such a case, which states have long agreed could not remain solely the preserve of national polities, but requires a common international response. This paper, placing the current crisis in light of the development of international health law, critically examines the response of key populist governments to COVID-19 in order to address the larger issue of the implications of populism for the fate of international law.

Six Faces of Globalization

Six Faces of Globalization PDF Author: Anthea Roberts
Publisher: Harvard University Press
ISBN: 0674245954
Category : Political Science
Languages : en
Pages : 401

Book Description
An essential guide to the intractable public debates about the virtues and vices of economic globalization, cutting through the complexity to reveal the fault lines that divide us and the points of agreement that might bring us together. Globalization has lifted millions out of poverty. Globalization is a weapon the rich use to exploit the poor. Globalization builds bridges across national boundaries. Globalization fuels the populism and great-power competition that is tearing the world apart. When it comes to the politics of free trade and open borders, the camps are dug in, producing a kaleidoscope of claims and counterclaims, unlikely alliances, and unexpected foes. But what exactly are we fighting about? And how might we approach these issues more productively? Anthea Roberts and Nicolas Lamp cut through the confusion with an indispensable survey of the interests, logics, and ideologies driving these intractable debates, which lie at the heart of so much political dispute and decision making. The authors expertly guide us through six competing narratives about the virtues and vices of globalization: the old establishment view that globalization benefits everyone (win-win), the pessimistic belief that it threatens us all with pandemics and climate change (lose-lose), along with various rival accounts that focus on specific winners and losers, from China to AmericaÕs rust belt. Instead of picking sides, Six Faces of Globalization gives all these positions their due, showing how each deploys sophisticated arguments and compelling evidence. Both globalizationÕs boosters and detractors will come away with their eyes opened. By isolating the fundamental value conflictsÑgrowth versus sustainability, efficiency versus social stabilityÑdriving disagreement and show where rival narratives converge, Roberts and Lamp provide a holistic framework for understanding current debates. In doing so, they showcase a more integrative way of thinking about complex problems.
