Institutionalisation beyond the Nation State

Institutionalisation beyond the Nation State PDF Author: Elaine Fahey
Publisher: Springer
ISBN: 3319502212
Category : Law
Languages : en
Pages : 266

Book Description
This volume collects papers that explore institutionalisation in contemporary transatlantic relations. Policymakers, lawyers, and political scientists reflect on contemporary understandings of the process as an integration of regimes and orders from an EU perspective. The papers assess whether contemporary transatlantic relations call for a different approach to global governance with a heightened emphasis on institutionalisation. The book explores a diverse range of case studies of interest to a broad readership. In particular, it focuses upon two cutting-edge issues: transatlantic data privacy rules that are emerging after the post-Edward Snowdon / NSA / PRISM revelations; and trade aspects, especially the Transatlantic Trade and Investment Partnership (TTIP) Agreement. The contributors consider these case studies from a variety of perspectives, honing in on the dynamism, method, and high politics of transatlantic relations as they have recently evolved. They critically explore the commonly held assumption that transatlantic relations have historically been considered quasi-institutionalised at best or, at worst, lacking in terms of laws and institutions. Is institutionalisation a useful meeting point for all disciplines? Does it explain regional integration meaningfully across subjects? Can institutionalisation serve to promote accountability and good governance? Contributors across disciplines and subjects address these increasingly challenging and salient questions.

EU Anti-Discrimination Law Beyond Gender

EU Anti-Discrimination Law Beyond Gender PDF Author: Uladzislau Belavusau
Publisher: Bloomsbury Publishing
ISBN: 1509915001
Category : Law
Languages : en
Pages : 393

Book Description
The EU has slowly but surely developed a solid body of equality law that prohibits different facets of discrimination. While the Union had initially developed anti-discrimination norms that served only the commercial rationale of the common market, focusing on nationality (of a Member State) and gender as protected grounds, the Treaty of Amsterdam (1997) supplied five additional prohibited grounds of discrimination to the EU legislative palette, in line with a much broader egalitarian rationale. In 2000, two EU Equality Directives followed, one focusing on race and ethnic origin, the other covering the remaining four grounds introduced by the Treaty of Amsterdam, namely religion, sexual orientation, disabilities and age. Eighteen years after the adoption of the watershed Equality Directives, it seems timely to dedicate a book to their limits and prospects, to look at the progress made, and to revisit the rise of EU anti-discrimination law beyond gender. This volume sets out to capture the striking developments and shortcomings that have taken place in the interpretation of relevant EU secondary law. Firstly, the book unfolds an up-to-date systematic reappraisal of the five 'newer' grounds of discrimination, which have so far received mostly fragmented coverage. Secondly, and more generally, the volume captures how and to what extent the Equality Directives have enabled or, at times, prevented the Court of Justice of the European Union from developing even broader and more refined anti-discrimination jurisprudence. Thus, the book offers a glimpse into the past, present and – it is hoped – future of EU anti-discrimination law as, despite all the flaws in the Union's 'Garden of Earthly Delights', it offers one of the highest standards of protection in comparative anti-discrimination law.

EU Foreign Policy Beyond the Nation State

EU Foreign Policy Beyond the Nation State PDF Author: Neil Winn
Publisher: Springer
ISBN: 0230514731
Category : Political Science
Languages : en
Pages : 204

Book Description
EU Foreign Policy Beyond the Nation-State analyses how the 'three pillar' structure of the European Union influences decisions in the Common Foreign and Security Policy (CFSP). The authors criticise traditional models of foreign policy analysis and go beyond existing state-centric approaches. They employ three case studies - Bosnia, Chechnya and former Yugoslavia/MOSTAR - to test the quality and the type of decisions taken in foreign policy beyond the nation-state.

European Enlargement Across Rounds and Beyond Borders

European Enlargement Across Rounds and Beyond Borders PDF Author: Haakon A. Ikonomou
Publisher: Taylor & Francis
ISBN: 1315460009
Category : History
Languages : en
Pages : 275

Book Description
This volume suggests new, theoretically informed approaches for historians and social scientists to engage with the policy of enlargement – across rounds and in all its diversity. It follows three approaches: first tracing Longue Durée developments; second, investigating enlargement Beyond the Road to Membership; and third, exploring the Entangled Exchanges and synergies between the EC/EU and its outside. It attempts to properly historicise the process of enlargement with contributions from historians, social scientists and a legal scholar exemplifying suggested approaches and theoretical reflections from the various disciplines.

Integrating UK and European Social Policy

Integrating UK and European Social Policy PDF Author: Robert Geyer
Publisher: Radcliffe Publishing
ISBN: 9781857757644
Category : Medical
Languages : en
Pages : 228

Book Description
Does the European Union really matter to British policy? For some it is a leading light, for others an irrelevancy. Given the uneven and evolving nature of EU policy, how can we evaluate its overall impact? This book is the first to combine a clear and detailed introduction to the new science of complexity and its application to social policy, Europeanisation, globalisation and the EU-UK relationship. It includes a detailed review of four key policy areas: employment, labour, gender and monetary relations. "Integrating UK and European Social Policy" provides groundbreaking reading for undergraduate and postgraduate students of politics, history, international relations, economics, social policy and applied social science. It is also useful for academics with an interest in European social policy, and policy makers and shapers, including government and non-government organisations.
