Book Description
"This document contains the New England Fishery Management Council's recommendations for Framework Adjustment 2 to the Atlantic Herring Fishery Management Plan (FMP) as well as the Atlantic herring fishery specifications for the 2013-2015 fishing years, consistent with the Magnuson-Stevens Fishery Conservation and Management Act (MSA) and the Herring FMP approved by the National Marine Fisheries Service (NMFS) on October 27, 1999. This document also contains information and supporting analyses required under other applicable law, including the National Environmental Policy Act (NEPA), Regulatory Flexibility Act (RFA), and Executive Order 12866. The actions proposed in this document also link to management objectives associated with minimizing bycatch in the herring fishery, the primary focus of Amendment 5 to the Herring FMP. If Amendment 5 is approved, the most notable changes (anticipated by the 2014 fishing year) would include a comprehensive catch monitoring program for the herring fishery, requirements for 100% observer coverage on Category A and B herring vessels, measures to address river herring bycatch, and measures to establish criteria for midwater trawl vessel access to groundfish year-round closed areas. The measures proposed in this Framework 2/specifications document that further support the Amendment 5 objectives include the proposed accountability measures (AMs) for the herring fishery and a 3% research-set aside for the 2013- 2015 fishing years, to support cooperative research focused on river herring bycatch avoidance and portside sampling"--Executive Summary (page i).

Book Description
The New England Fishery Management Council, in consultation with NOAA's National Marine Fisheries Service, proposes to adopt and implement Amendment 5 to the Atlantic Herring Fishery Management Plan (FMP) pursuant to the Magnuson-Stevens Fishery Conservation and Management Act (MSA). This Final EIS presents the proposed action selected by the Council in Amendment 5, which relates to the goals and objectives outlined in the document. Amendment 5 was developed through a public process consistent with the National Environmental Policy Act (NEPA). The proposed action focuses on establishing a comprehensive catch monitoring program for the limited access herring fishery, addressing river herring bycatch in the herring fishery, establishing criteria for midwater trawl vessel access to groundfish closed areas, and adjusting other aspects of the fishery management program to keep the Herring FMP in compliance with the MSA. This FEIS document also includes a detailed description of the affected environment and valued ecosystem components (VECs), and analyses of the impacts of the proposed action on the VECs, as well as a cumulative effects analysis. It addresses the requirements of the MSA, NEPA, the Regulatory Flexibility Act (RFA), and other applicable laws and Executive Orders. Several alternatives to the proposed action and other management approaches were considered by the Council during the development of Amendment 5; the non-preferred alternatives are described and analyzed in this document as well, relative to the proposed action and relative to taking no action. Alternatives considered but rejected by the Council are also discussed.

Book Description
"This amendment is needed to bring the Herring FMP into compliance with Magnuson-Stevens Fishery Conservation and Management Act requirements by: Revising definitions and the specifications-setting process, consistent with annual catch limit requirements; and establishing fishery closure thresholds, a haddock incidental catch cap, and overage paybacks as accountability measures. In addition, measures in Amendment 4 will: Designate herring as a 'stock in the fishery;' establish an interim acceptable biological catch control rule; eliminate total foreign processing, including joint venture processing and internal waters processing, and reserve from the specifications process; and eliminate the New England Fishery Management Council's consideration of total allowable level of foreign fishing"--Cover letter.
