Publisher: BRILL
ISBN: 9004480544
Category : Law
Languages : en
Pages : 273

Book Description
The book’s compelling thesis is that the role of the forum non conveniens should be strengthened and even enhanced, particularly in light of modern advancements such as Internet transactions, efficient jet travel and telecommunications facilitating transfer of documents and testimony. Karayanni argues, more importantly, that in order to face technological complexities, the forum non conveniens doctrine needs to undergo a basic transformation. He proposes that American and English law doctrines similar to the forum non conveniens, like the reasonableness test and the forum conveniens doctrine, be integrated. Published under the Transnational Publishers imprint.

Transnational Litigation in Comparative Perspective

Transnational Litigation in Comparative Perspective PDF Author: Stephen C. McCaffrey
Publisher:
ISBN:
Category : Law
Languages : en
Pages : 750

Book Description
Transnational Litigation in Comparative Perspective: Theory and Application is the only casebook that examines the principal issues in transnational litigation from a comparative perspective. Each chapter focuses on a particular core problem that all legal systems must address. The first half of each chapter is devoted to exploring the theoretical context of the issue, thereby enabling students to appreciate the complexity of the problem and to see how achieving a resolution requires balancing competing interests. The second part of each chapter then focuses on how different systems deal with these challenges. Topics covered include protective measures, personal jurisdiction, forum non conveniens, forum selection clauses, state immunity, state doctrine, service of process, gathering evidence abroad, choice of law, and recognition and enforcement of foreign judgments. Distinctive Features *Uses a comparative approach that better prepares future lawyers for international litigation that may be initiated in countries other than the U.S. *Offers a hypothetical at the beginning of each chapter to introduce the fundamental issue; the hypotheticals raise questions that are diagnostic rather than prescriptive, leading to many "right" answers *Accommodates different types of courses--professors who employ a less theoretical approach can use the hypotheticals to ground class discussions *Considers issues unique to arbitration as they arise in connection with the various topics studied

Forum Shopping Despite Unification of Law

Forum Shopping Despite Unification of Law PDF Author: Franco Ferrari
Publisher: BRILL
ISBN: 9004502920
Category : Law
Languages : en
Pages : 464

Book Description
According to some commentators, forum shopping is an “evil” that must be eradicated. It has been suggested that the unification of substantive law through international conventions constitutes one way to achieve this outcome. This book shows that the drafting of uniform substantive law convention cannot prevent forum shopping. The reasons are classified into two main categories: convention-extrinsic and convention-intrinsic reasons. The former category comprises those reasons upon which uniform substantive law conventions do not have an impact at all. These reasons range from the costs of access to justice to the bias of potential adjudicators to the enforceability of judgments. The convention-intrinsic reasons, on the other hand, are reasons that relate to the nature and design of uniform substantive law conventions, and include their limited substantive and international spheres of application as well as their limited scope of application, the need to provide for reservations, etc. This book also focuses on another reason why forum shopping cannot be overcome: the impossibility of ensuring uniform applications and interpretations of the various uniform substantive law conventions.

The Strength and Weakness of Comparative Law

The Strength and Weakness of Comparative Law PDF Author: Bernhard Grossfeld
Publisher: Oxford University Press, USA
ISBN:
Category : History
Languages : en
Pages : 144

Book Description
This book is a unique and stylish reflection on the true value of comparative legal research. Arguing that the presumption of similarity that underlies much comparative legal research is dangerous and faulty, Grossfeld draws examples from the German and American legal systems to discuss legislation, private and public international law, domestic law, culture and law, geography and law, language and law, and religion and law.

An Introduction to the Comparative Study of Private Law

An Introduction to the Comparative Study of Private Law PDF Author: James Gordley
Publisher: Cambridge University Press
ISBN: 1108872352
Category : Law
Languages : en
Pages : 735

Book Description
This collection of readings places side by side the principal doctrines of contracts, torts, unjust enrichment, and property in the cases of the United States, England, France, Germany and China. It presents code provisions, cases, and other legal materials that describe the law in force, and places each doctrine in its historical context to enable an understanding of the development of law as an ongoing process, in which the resolution of current issues depends upon how past issues were resolved. It both provides a road map of the private law of these jurisdictions, and illustrates how private law has been shaped by history, by the effort to solve common problems, and by differences in culture. This new edition reflects changes in the law, and includes the addition of Chinese Law as a comparative study.

Always on the Same Path - Volume II

Always on the Same Path - Volume II PDF Author: B. S. Markesinis
Publisher: Hart Publishing
ISBN:
Category : Law
Languages : en
Pages : 472

Book Description
Markesinis (common and civil law, University College, London) notes that many of the legal doctrines considered uniquely English were actually elaborated by writers conversant with French and German law. He decries the lack of comparative study in present day England and attempts to demonstrate the utility of comparative legal studies in 11 chapters (one written in German). For the most part, the essays explore issues of German law. Specific topics include the horizontal effect of the German human rights bill, tortious liability of statutory bodies, judicial style and reasoning in England and Germany, developing an English law of privacy, and foreign ideas and law in the English Courts.
