Foreign Trade, Investment, and the Law in the People's Republic of China PDF Author: Michael J. Moser
Publisher: Oxford University Press, USA
ISBN:
Category : Business & Economics
Languages : en
Pages : 624

Book Description
Since the adoption of an 'open-door' economic policy in 1978, foreign trade with the People's Republic of China has increased dramatically. At the same time, 'new' forms of economic activity, such as compensation trade, licensing, co-operative production and equity joint ventures have becomepossible for the first time. In order to regulate the nation's expanded and increasingly complex business activity, the Chinese government has, during the past few years, promulgated scores of new laws relating to business transactions involving foreigners; many others are now being drafted. This book, now extensively revised and updated in a second edition, provides an introduction to the legal framework currently being developed in China with respect to foreign commerical and investment activity. The eighteen chapters in the volume, each written by a lawyer with practical experience in China trade, deal with such matters as customs regulations, taxation, representative offices, leasing, the transfer of technology, foreign investment, contracts, banking, dispute settlement, the framework oflaw in the special investment zones and in offshore oil production, China's environmental law and patent law, trade marks, sovereign immunity and the foreign regulation of trade with China. In addition, the book includes a valuable appendix containing a list of China's most important foreigneconomic legislation.

China’s Foreign Investment Law Amid Evolving International Investment Rules

China’s Foreign Investment Law Amid Evolving International Investment Rules PDF Author: Qingjiang Kong
Publisher: Springer Nature
ISBN: 9819921589
Category : Law
Languages : en
Pages : 210

Book Description
This book focuses on an article-by-article interpretation of the Foreign Investment Law of the People's Republic of China, which was adopted on March 15, 2019. It also describes the legislative process of the law and the relationship between the law and other laws and regulations. It also includes a comparison of China's new foreign investment law with representative foreign investment regimes and the interaction between China and evolving international investment rules and the law, with a focus on the impact of evolving international investment rules on the development of China's foreign investment regime. In recent years, the momentum of globalization has continued to grow, and a pattern of economic governance with valorization, regionalization, and benefit sharing has gradually emerged. Amid the emergence of new international investment rules, the Foreign Investment Law of the People's Republic of China, adopted on March 15, 2019, has significantly changed the face of China's foreign investment regime. Given that China is a major destination for global foreign direct investment flows, its foreign investment regime is a focus of attention for international investors and international lawyers. This book aims to provide a practical legal guide for students of Chinese law, especially Chinese business law, practitioners, and their clients interested in the Chinese market, and observers of international investment law and national investment law practice.

China's International Investment Strategy

China's International Investment Strategy PDF Author: Julien Chaisse
Publisher: Oxford University Press, USA
ISBN: 0198827458
Category :
Languages : en
Pages : 561

Book Description
Since China adopted its 'open door' policy in 1978, which altered its development strategy from self-sufficiency to active participation in the world market, its goal has remained unchanged: to assist the readjustment of China's economy, to coordinate its modernization programs, and to improve its quality of life. With the 1997 launch of the 'Going Global' policy, an outward focus regarding foreign investment was added, to circumvent trade barriers and improve the competitiveness of Chinese firms. In order to accommodate inward and outward investment, China's participation in the international investment regime has underpinned its efforts to join multilateral investment-related legal instruments and conclude international investment agreements. This collection, compiled by award-winning scholar Professor Julien Chaisse, explores the three distinct tracks of China's investment policy and strategy: bilateral agreements including those with the US and the EU; regional agreements including the Free Trade Area of the Asia Pacific; and global initiatives, spear-headed by China's presidency of the G20 and its 'Belt and Road initiative'. The book's overarching topic is whether these three tracks compete with each other, or whether they complement one another - a question of profound importance for the country's political and economic future and world investment governance.

Foreign Direct Investment in China

Foreign Direct Investment in China PDF Author: Philip D. Grub
Publisher: Praeger
ISBN:
Category : Business & Economics
Languages : en
Pages : 306

Book Description
Written for international business managers and executives, this book offers a comprehensive and authoritative discussion of foreign direct investment in the People's Republic of China. The authors note at the outset that although the events of Tiananmen Square brought both trade and investment to a virtual standstill, new investment is now again flowing into China (but at a guarded pace). For those wishing to pursue the numerous opportunities that still exist, this volume offers a full analysis of the risks involved, a thorough treatment of the different forms of investment activities in China, complete coverage of China's investment policies and incentives, and specific case studies of foreign direct investment in China. The authors begin by providing an overview of the Open Door Policy and China's economic and managerial systems. Next, they discuss special economic zones and open cities; investment policies, such as flexible foreign ownership and choice of investment location; new incentives after 1986; and investment motivations. The modes of foreign investment covered include equity joint ventures, contractual joint ventures, wholly foreign-owned enterprises, joint oil exploration, compensation, and trade. Separate chapters analyze foreign investment inflows, identify the organizations involved in foreign investment, describe investment negotiation and approval procedures, and provide a detailed example of a joint venture feasibility study. Three case studies and an evaluation of the outlook for future foreign investment in China complete the volume. Numerous explanatory tables and figures amplify points made in the text. Two appendixes provide a sample contract and articles of association for joint ventures in China and the regulations for development and opening of the Shanghai Pudong New Area. A third appendix lists the rules for the implementation of Chinese law on wholly foreign-owned enterprises in China.
