The European Union's market integration project has dramatically altered economic activity around Europe. This book presents extensive evidence on how trade has increased, jobs have been created, and European business has been reorganized. The changes in the economy have been accompanied by dramatic changes in how people from different societies interact. This book argues provocatively that these changes have produced a truly transnational-European-society. The book explores the nature of that society and its relationship to the creation of a European identity, popular culture, and politics. Much of the current political conflict around Europe can be attributed to who is and who is not involved in European society. Business owners, managers, professionals, white-collar workers, the educated, and the young have all benefited from European economic integration, specifically by interacting more and more with their counterparts in other societies. They tend to think of themselves as Europeans. Older, poorer, less educated, and blue-collar citizens have benefited less. They view the EU as intrusive on national sovereignty, or they fear its pro-business orientation will overwhelm the national welfare states. They have maintained national identities. There is a third group of mainly-middle class citizens who see the EU in mostly positive terms and sometimes-but not always-think of themselves as Europeans. It is this swing group that is most critical for the future of the European project. If they favor more European cooperation, politicians will oblige. But, if they prefer that policies remain wedded to the nation, European cooperation will stall.

Centripetal democracy is the idea that legitimate democratic institutions set in motion forms of citizen practice and representative behaviour that serve as powerful drivers of political identity formation. Partisan modes of political representation in the context of multifaceted electoral and direct democratic voting opportunities are emphasised on this model. There is, however, a strain of thought predominant in political theory that doubts the democratic capacities of political systems constituted by multiple public spheres. This view is referred to as the lingua franca thesis on sustainable democratic systems (LFT). Inadequate democratic institutions and acute demands to divide the political system (through devolution or secession), are predicted by this thesis. By combining an original normative democratic theory with a comparative analysis of how Belgium and Switzerland have variously managed to sustain themselves as multilingual democracies, this book identifies the main institutional features of a democratically legitimate European Union and the conditions required to bring it about. Part One presents a novel theory of democratic legitimacy and political identity formation on which subsequent analyses are based. Part Two defines the EU as a demoi-cracy and provides a thorough democratic assessment of this political system. Part Three explains why Belgium has largely succumbed to the centrifugal logic predicted by the LFT, while Switzerland apparently defies this logic. Part Four presents a model of centripetal democracy for the EU, one that would greatly reduce its democratic deficit and ensure that this political system does not succumb to the centrifugal forces expected by the LFT.

This book presents an analysis of the recent development of administrative procedures in EC law. It is a pathbreaking study of what might be termed the “constitutionalising norms” now emerging,including a range of 'process rights' and procedural standards, such as the right to access to information, the right to be heard, the principle of care and duty to state reasons. This monograph offers a longitudinal analysis of the developments in the European fundamental rights arena during the last decade. Decisions of critical importance on the future of the EU need to be taken by the EU institutions and the Member States' governments. The ‘existential’ crisis affecting Europe is essentially a crisis of values revealing a lack of shared vision. Based on this premise, this monograph contributes to the debate on how to overcome the current impasse. By situating the analysis of the EU in the context of a wider Europe, which includes the ECHR (and its interpretation by the ECtHR), this work challenges the idea that the project of European integration should be abandoned. Instead it proposes a re-orientation of this process, conceptualised as a dynamic interaction of different actors, sources and laws on fundamental rights within the wider Europe. Following an evaluation of the current fundamental rights’ regimes, the monograph proposes a model of effective governance of fundamental rights in Europe based on the doctrines of dialogical constitutionalism and agency. This original and innovative contribution is enriched by findings from British Academy funded research on the European architecture of fundamental rights post-Lisbon Treaty.
