What is public interest law? How effective is it? What are the limits to litigation as a mechanism for conflict resolution? In this study, economists, lawyers, and sociologists evaluate an institutional form that is new to American society and, indeed, to the world--the public interest law (PIL) organization. The book introduces the reader to the structure, resources, and activities of this "nonprofit industry," and also to the factors that affect PIL firms in their choices of cases and methods of handling them. The authors examine PIL's vast range of contemporary public policy concerns. These incude such general topics as the environment, consumerism, housing, employment discrimination, medical care, occupational health and safety, education finance, and taxation. A number of base studies are presented, and a method for economic analysis and evaluation is introduced and applied. The study points to PIL's success in advocating under-represented interests, in winning courtroom decisions, and in translating legal victories into reallocations of resources. At the same time, it notes the bias of PIL towards test-case litigation, a propensity to focus on judicial victories rather than on real social change, and a tendency to use lawyers even when other types of professionals might be more effective. Many of these problems stem from uncertainty of funding and legal restrictions on "nonprofit" organizations. The result is a set of hurdles that distracts PIL firms from their principal goals. The authors do not limit themselves to PIL, but comment on the effectiveness of legal instruments as devices for social change, and on the behavior of the voluntary nonprofit sector, a little-studied portion of the economy. The book presents a fresh approach to the study of both collective-type economic problems and institutional setting in which public interest law works. Following a surge in oil revenues in the 1970s, Nigeria became one of Africa’s most rapidly developing nations. In Nigerian Capitalism, Sayre P. Schatz analyzes the country’s political economy, assessing its position and proposing a development plan for the final quarter of the twentieth century. Referring to Nigeria’s economic development strategy as "nurture-capitalism," Sayre contrasts the role of private enterprise, which is expected to foster growth of the productive sector of the economy, with the government’s role, which is to nurture the capitalist sector generally and to favor indigenous enterprise in particular. The author examines the development of Nigerian nurture-capitalism from 1949 to the launching of and early experience with the Third Plan (1975–80), with emphasis on the post-civil war 1970s. He then turns to an intensive study of indigenous business and possible impediments to the development of Nigerian private enterprise, analyzing the role of capital availability, entrepreneurship, and the economic environment. Sayre demonstrates that there are substantial divergences between private profitability and social utility and that there is an abundance of socially useful investment possibilities for indigenous businessmen. Economic Development in Ghana and Malaysia investigates why two countries that appeared to be at more or less the same stage of economic development at one point in time have diverged so substantially. At the time of their independence from the UK in 1957, both Ghana and Malaysia were at roughly the same stage of economic development; in fact, Ghana’s real per capita income was slightly ahead of Malaysia’s. Since then, Ghana’s development has been sluggish, while Malaysia’s economy has taken off into sustained growth and today, the real per capita income of Malaysia is about five times that of Ghana. This volume examines the pre-colonial and colonial economies of both countries, and the economic policies pursued after independence. In doing so, it aims to identify policies which might have contributed to Malaysia’s development and those which might have slowed Ghana’s. The authors ask whether lessons can be learned from the successes of countries such as Malaysia. By the mid-1980s, Sudan’s economy, society and political framework were on the point of disintegration. Civil war was exacerbating the effects of an already major famine. An unpopular government was resorting to ever more extreme measures in order to remain in power. The imposition of a particularly oppressive and hash interpretation of sharia law was heightening racial and religious tensions. Internationally, Sudan was faced by a debt crisis which was apparently insoluble, and which threatened to undermine completely what was left of the economy. This book, first published in 1988, examines the complex economic and social processes which led to this situation – emphasising the part played by the state itself. The book combines detailed multi-disciplinary analyses of Sudan in the post-colonial era with a consideration of possibilities for the future.
