Book Description
In its broadest sense, biometrics is the measurement and analysis of a biological characteristic (fingerprints, iris patterns, retinas, face or hand geometry) or a behavioural characteristic (voice, gait or signature). Biometric technologies use these characteristics to identify individuals automatically. Unlike identity documents or passwords, biometrics cannot be lost or forgotten since they are a part of the user and are always present at the time of identification. They are also difficult, though not impossible, to forge or share. Three future trends in the application of biometrics were identified during the inquiry: (i) the growth of unsupervised biometric systems, accessed via mobile devices, which verify identity; (ii) the proliferation of "second-generation" biometric technologies that can authenticate individuals covertly; (iii) and the linking of biometric data with other types of 'big data' as part of efforts to profile individuals. Each of these trends introduces risks and benefits to individuals, to the state and to society as a whole. They also raise important ethical and legal questions relating to privacy and autonomy. The Committee are not convinced that the Government has addressed these questions, nor are they satisfied that it has looked ahead and considered how the risks and benefits of biometrics will be managed and communicated to the public.

The FCO designated 28 countries of concern in its 2013 report, where it judged the gravity of the human rights abuses to be so severe that a particular focus should be applied. The Committee concentrated attention on three of these countries: Sri Lanka, Burma, and Israel and the Occupied Palestinian Territories. Favourable trade concessions to the EU market should be removed from Sri Lanka if the Government of Sri Lanka continues to deny the OHCHR investigation team access into the country. The Government should advocate re-imposition of sanctions by the EU if there is no improvement in the human rights situation in Burma. The human rights of Israeli, Palestinian and Bedouin citizens living in Israel and the Occupied Palestinian Territories continue to be of serious concern to the UK.

The last five years have seen a range of international developments, ranging from the growth of radicalisation and fundamentalism, to growing concerns around our energy supply, and rising aggression from Russia. The NSS must be flexible enough to support contingency planning, and in this Report the Committee recommends that the Government produce a classified NSS or annex which can be used in Government departments to influence planning assumptions for a range of scenarios. In its report the Committee said that the next NSS should look hard at the UK's place within the international order, and what strategic thinking should underpin its actions over the next five years. It also needs to influence the Comprehensive Spending Review, to ensure that the Government can make fully-informed decisions on security-related spending. The next NSS should set clear objectives for the UK's future place in the world and geopolitical priorities, and inform the Strategic Defence and Security Review's assessment of the means required to achieve them.

In this Report the Committee returns to follow up the Report which was published in January 2012 (ISBN 9780215040589) on the operation of the common-law doctrine of joint enterprise, which forms part of the criminal law relating to secondary liability. The types of cases considered are those in which P and D participate together in one crime and in the course of it P commits a second crime which D had foreseen he might commit: in such cases, under joint enterprise, D may also be charged and convicted of the second offence. The Committee considers in this report the impact of the guidance for prosecutors in joint enterprise cases which the Crown Prosecution Service (CPS) produced in response to one of the 2012 recommendations, taking into account statistics on murder and manslaughter cases with two or more defendants in 2012 and 2013 which the CPS also produced. The Committee concludes that the level of concern about the operation of joint enterprise, especially in murder cases, is such that it is no longer acceptable for the main authorities in the criminal justice system to give such limited attention and priority to the recording and collation of information and reommends that the Ministry of Justice establish a system to enable production of regular statistics on joint enterprise prosecutions, convictions and appeals. This report sets out a range of other concerns and questions which continue to be raised about the application of the doctrine, including the scale of use of joint enterprise, the question as to whether joint enterprise is being used as a social policy tool, the high number of Black and mixed race young men who have been convicted of joint enterprise offences. The evidence heard in this second inquiry into the subject has increased disquiet at the functioning of the law on joint enterprise and the Committee is no longer of the view that it is satisfactory for a consultation to be held on the Law Commission's previous proposals on joint enterprise.
