Bien que profondément marquée par son caractère d’ordre public, l’exécution forcée offre des espaces de liberté dans lesquels des accords de volonté peuvent être conclus. Cela se vérifie à l’occasion des procédures civiles d’exécution et des procédures de distribution des deniers. Mais ce premier mouvement de contractualisation de l’exécution forcée permettant un adoucissement de la contrainte coexiste désormais avec un second dans lequel les accords de volonté sont spécialement passés en vue d’éviter le recours aux procédures civiles d’exécution en renforçant une contrainte à fin d’exécution. Ces accords tendent soit à rendre l’exécution forcée toujours plus subsidiaire par rapport à l’exécution volontaire soit à organiser une satisfaction automatique du créancier juridiquement acquise malgré l’inexécution et sans concours du débiteur. Si dans le premier cas, ils renvoient aux incitations à l’exécution volontaire, ils réalisent dans le second, une exécution tout à la fois forcée, privée et alternative. En conséquence, la notion d’exécution forcée a évolué. Si cette transformation est, dans l’ensemble, positive en favorisant et consolidant l’effectivité des droits, elle impose que l’utilisation de procédés de contrainte reste toujours strictement encadrée.

Water is vital for life, and its availability has been a concern for mankind throughout the ages.
