Liberty and Security in Europe

Liberty and Security in Europe PDF Author: Stefano Ruggeri
Publisher: V&R unipress GmbH
ISBN: 3899719670
Category : Law
Languages : en
Pages : 299

Book Description
Over recent years, most of the criminal justice systems in Europe have witnessed a tendency to enhance the role of pre-trial inquiries. Different kinds of pre-trial measures have had a heavy impact on the fundamental rights of individuals involved in criminal procedures. This book contains a comparative study of four European countries on pre-trial precautionary measures limiting personal liberty. This comparison is part of two general frameworks concerning the ECtHR case-law and the EU legislation in the field of the right to liberty and security. In its two level approach, the book provides a critical guide for understanding the most significant changes which occurred in the area of liberty and security in the pre-trial phases of criminal proceedings as well as the protection systems developed in Europe both at national and supranational level to face the new challenges of the modern criminal investigation.

Ideas of Liberty in Early Modern Europe

Ideas of Liberty in Early Modern Europe PDF Author: Hilary Gatti
Publisher: Princeton University Press
ISBN: 0691176116
Category : Philosophy
Languages : en
Pages : 225

Book Description
Europe's long sixteenth century—a period spanning the years roughly from the voyages of Columbus in the 1490s to the English Civil War in the 1640s—was an era of power struggles between avaricious and unscrupulous princes, inquisitions and torture chambers, and religious differences of ever more violent fervor. Ideas of Liberty in Early Modern Europe argues that this turbulent age also laid the conceptual foundations of our modern ideas about liberty, justice, and democracy. Hilary Gatti shows how these ideas emerged in response to the often-violent entrenchment of monarchical power and the fragmentation of religious authority, against the backdrop of the westward advance of Islam and the discovery of the New World. She looks at Machiavelli's defense of republican political liberty, and traces how liberty became intertwined with free will and religious pluralism in the writings of Luther, Erasmus, Jean Bodin, and Giordano Bruno. She examines how the St. Bartholomew's Day Massacre and the clash of science and religion gave rise to concepts of liberty as freedom of thought and expression. Returning to Machiavelli and moving on to Jacques Auguste de Thou, Paolo Sarpi, and Milton, Gatti delves into debates about the roles of parliamentary government and a free press in guaranteeing liberties. Drawing on a breadth of canonical and lesser-known writings, Ideas of Liberty in Early Modern Europe reveals how an era stricken by war and injustice gave birth to a more enlightened world.

Islam, Religious Liberty and Constitutionalism in Europe

Islam, Religious Liberty and Constitutionalism in Europe PDF Author: Mark Hill KC
Publisher: Bloomsbury Publishing
ISBN: 150996696X
Category : Political Science
Languages : en
Pages : 457

Book Description
For centuries, since the Roman Empire's adoption of Christianity, the continent of Europe has been perceived as something of a Christian fortress. Today, the increase in the number of Muslims living in Europe and the prominence of Islamic belief pose questions not only for Europe's religious traditions but also for its constitutional make up. This book examines these challenges within the legal and political framework of Europe. The volume's contributors range from academics at leading universities to former judges and politicians. Its 19 chapters focus on constitutional challenges, human rights with a focus on religious freedom, and securitisation and Islamophobia, while adopting supranational and comparative approaches. This book will appeal not merely to academics and law students in the UK and the EU, but to anyone involved in diplomacy and international relations, including political scientists, lobbyists and members of NGOs. It explores these contested relationships to open up new spaces in how we think about religious freedom and co-existence in Europe and the crucial role that Islam has had, and continues to have, in its development.
