This book presents comparative analyses and accounts of the institutional changes that have occurred to the local level delivery of public utilities and personal social services in countries across Europe. Guided by a common conceptual frame and written by leading country experts, the book pursues a “developmental” approach to consider how the public/municipal sector-centred institutionalization of service delivery (climaxing in the 1970s) developed through its New Public Management-inspired and European Union market liberalization-driven restructuring of the 1980s and early 1990s. The book also discusses the most recent phase since the late 1990s, which has been marked by further marketization and privatization of service delivery on the one hand, and some return to public sector provision (“remunicipalization”) on the other. By comprising some 20 European countries, including Central East European “transformation” countries as well as the “sovereign debt”-stricken countries of Southern Europe, the chapters of this volume cover a much broader cross section of countries than other recent publications on the same subject.

The book examines sustainable food procurement policy and practice in the European Union and beyond, exploring the extent to which sustainability objectives have been achieved and evaluating the new developments taking place at both EU and national levels. While there is a growing recognition that public authorities can use public procurement as a policy tool to pursue multiple environmental, health and socio-economic objectives, contracting authorities still face many challenges. This volume investigates the scope for pursuing sustainable objectives in public procurement of food and catering services, examining different regulatory contexts and organisational models to answer the overall question of how to integrate sustainability concerns into the various phases of public food procurement processes. Le contrat de partenariat permet aux collectivités de confier globalement à un opérateur économique aussi bien le financement d'ouvrages ou d'équipements que leur conception, leur construction, leur exploitation ou encore la gestion de services publics, en s'abstenant d'être maîtres d'ouvrage et en rémunérant l'opérateur par des paiements échelonnés tout au long de la durée du contrat. L'analyse approfondie de ce montage contractuel, notamment appliqué aux secteurs ferroviaires et routiers, permet-elle réellement de conclure à l'amorce d'une modernisation du droit des contrats de la commande publique ? Rien n'est moins sûr. En effet, selon l'aspect considéré, il apparaît que le contrat de partenariat a, malgré les espoirs qu'il a vu naitre à cette fin, bien du mal à s'imposer comme la clef de voûte d'une véritable modernisation du droit des contrats de la commande publique. Démontrer que le contrat de partenariat a à la fois échoué et en partie, au moins, amorcé ce renouveau implique l'examen des trois aspects fondamentaux de la vie des contrats de la commande publique que sont leur passation, leur financement et leur exécution. Cet essai fait apparaître que si le contrat de partenariat n'a pas créé une véritable révolution du droit de la commande publique, il a néanmoins posé les bases d'une modernisation désormais en cours, tant en matière de financement que d'exécution.

La notion de convention de délégation de service public est apparue récemment en droit positif francais. Cependant, si le législateur a consacré cette notion, il ne l'a pas définie laissant ce soin au juge. Pourtant, une définition de cette convention s'avèré necessaire, notamment pour délimiter le champ d'application de son régime juridique. après analyse, il apparaît que la convention de délégation de service public est le contrat par lequel une collectivité publique transfère l'exploitation d'un service public à son cocontractant. L'objet du contrat est un élément essentiel de la définition de cette convention. il permet, en effet, de la distinguer des autres types de contrats administratifs, en particulier du marche public. Cette définition fondée sur un critère matériel (l'objet du contrat) présente l'intêret de mettre en valeur la spécificité de la convention de délégation de service public qui ne se confond pas avec la "traditionnelle" concession de service public, cette dernière ne constituant qu'une formule contractuelle parmi d'autres de délégation de l'exploitation d'un service public. Il en résulte que les éléments de définition de la délégation ne sont pas forcément identiques à ceux de la concession. c'est le cas, par exemple, du mode de rémuneration du contractant de l'administration qui n'est pas, contrairement a ce qui est affirmé en jurisprudence et en doctrine, un critère d'identification de la délégation de service public permettant de distinguer celle-ci du marché public. Ce critère "financier" de la rémunération du délégataire est au demeurant utile pour faire des distinctions au sein de la catégorie des conventions de délégation de service public qui comprend en particulier, outre la concession, l'affermage, la régie intérèssée, la gérance, le marche d'entreprise de service public ainsi que, sous certaines conditions, d'autres contrats tel que le bail emphytéotique administratif.
