On one side, majorities seek to fashion the state in their own image, while on the other, cultural minorities press for greater recognition and accommodation. Theories of liberal democracy are at odds about the merits of these competing claims. Multicultural liberals hold that particular minority rights are a requirement of justice conceived of in a broadly liberal fashion. Multiculturalism is not à la mode nowadays. It is attacked by both right-wing populists and mainstream politicians and leaders of liberal democracies. Indeed, conflicts surrounding cultural diversity and recognition are among the most salient issues in contemporary societies. Should liberal democracies recognise specific cultural rights of minorities? If so, should they grant rights only to indigenous national minorities or also to immigrants? Is such a recognition compatible with the basic liberal principle of state neutrality? Practical questions of this kind are in quest of sound theoretical foundations. Drawing on the philosophy of Hegel, they envision a system of reciprocal knowledge and esteem, in which the affirming glance of others lets everyone be who they really are. During the past three decades, nations all over the world have been debating whether to allow same-sex couples to marry, or at least grant these couples various rights associated with marriage. In Equality for Same-Sex Couples, Yuval Merin presents the first comparative study of the legal regulation of same-sex partnerships worldwide, as well as a unique survey of the status of same-sex couples in Europe. Merin begins by providing a historical overview of the transformation of marriage from antiquity to the present. He then identifies and critically compares four principal models for the legal regulation and recognition of same-sex partnerships: civil marriage, registered partnership, domestic partnership, and cohabitation. Merin concludes that all of the models except civil marriage discriminate against gays and lesbians just as the "separate but equal" doctrine discriminated against African Americans; thus, so-called alternatives to marriage, even if they provide the same rights and benefits as marriage, are inherently unequal and therefore unconstitutional.

Recognition, though it figures profoundly in our understanding of objects and persons, identity and ideas, has never before been the subject of a single, sustained philosophical inquiry. This work, by one of contemporary philosophy’s most distinguished voices, pursues recognition through its various philosophical guises and meanings—and, through the “course of recognition,” seeks to develop nothing less than a proper hermeneutics of mutual recognition. Originally delivered as lectures at the Institute for the Human Sciences at Vienna, the essays collected here consider recognition in three of its forms. The first chapter, focusing on knowledge of objects, points to the role of recognition in modern epistemology; the second, concerned with what might be called the recognition of responsibility, traces the understanding of agency and moral responsibility from the ancients up to the present day; and the third takes up the problem of recognition and identity, which extends from Hegel’s discussion of the struggle for recognition through contemporary arguments about identity and multiculturalism.
