Este trabalho apresenta o processo histórico que levou a expressão gestão democrática do ensino público na forma da lei a aparecer no texto da Constituição de 1988. Para tanto, olha para a discussão sobre gestão democrática do ensino público do ponto de vista do Movimento em Defesa da Escola Pública, que retoma princípios do Movimento dos Pioneiros da Educação Nova,no entanto colocando como cerne da questão a luta por democracia e participação na gestão da escola. Apresenta uma leitura do processo de tramitação da matéria Gestão democrática do ensino público no processo de elaboração do texto constitucional, e reconstitui a história das Conferências Brasileiras de Educação organizadas na década de 1980. O Fórum Nacional em Defesa da Escola Pública atuou no processo de elaboração da Constituição Federal de 1988, da Lei de Diretrizes e Bases da Educação Nacional de 1996, e na elaboração dos Planos Nacionais de 2002-2012 e 2014-2024, como movimento educacional organizado, trazendo as discussões das entidades que o compõem para a elaboração e implementação de políticas públicas na área educacional.
