"Esta obra, continuación de una serie de trabajos anteriores sobre la regla de Derecho y sobre el Estado, está consagrada al derecho subjetivo. El lector no debe esperar ver tratado aquí, so color de derecho subjetivo, el problema de las relaciones del individuo y la colectividad, y el especial de la suma de derechos y libertades que corresponden al individuo en el estado de vida social organizada. Ese es asunto de legislación, de política y, finalmente, de filosofía. La cuestión que nos proponemos estudiar es la siguiente: en el sistema jurídico positivo interviene una noción, la de derecho subjetivo, cuyo fundamento y significación se trata de investigar, y después construir la «teoría». Sin duda habrá que preguntarse si el individuo humano está capacitado para ser titular de derecho subjetivo; y la contestación implicará una toma de posición filosófica. Pero esa pregunta puede plantearse en relación con otros seres que el individuo humano, comenzando por el mismo Estado en sus relaciones con los otros Estados, y también, en el plano interno, en sus relaciones con los individuos que lo constituyen. De modo que el problema del derecho subjetivo, para el jurista, no se confunde con el problema del individualismo en el Derecho. Cualquiera que sea el lugar, amplio o estrecho, que se le dé en el derecho positivo al derecho subjetivo del individuo, el problema del derecho subjetivo surge, en su contextura formal, independientemente de toda referencia a una doctrina política o social".
