Dado el carácter fundamental del salario en la relación laboral, resulta evidente que la determinación del salario constituye una operación esencial para que desde la perspectiva del trabajador se cumpla el principal objeto del contrato de trabajo, que es el abono por parte del empresario de la remuneración legalmente establecida. La Ley 11/1994, de 19 de mayo de reforma del Estatuto de los Trabajadores vino a potenciar la flexibilidad salarial produciendo un cambio en el sistema de fuentes de determinación de la estructura salarial donde se otorgaba al convenio colectivo y al contrato de trabajo el papel de instrumentos básicos de ordenación y determinación del salario. Con esta norma se produjo una reducción del intervencionismo estatal, a lo que se suma la supresión de la normativa reglamentaria anterior y el proceso de sustitución de las Ordenanzas Laborales. El Estatuto de los Trabajadores optó por remitir la regulación del salario a la negociación colectiva. Por último, en el supuesto de que el convenio colectivo no fije el salario o no haya convenio aplicable, se va a aplicar lo que las partes de la relación laboral hayan fijado en el contrato de trabajo. En nuestro estudio analizamos el sistema de fuentes del ordenamiento-jurídico laboral. En concreto, cuáles son las funciones de la ley, convenio colectivo y del contrato de trabajo en la fijación de los salarios y cómo se articulan entre sí atendiendo a los criterios de flexibilidad y racionalización y, en definitiva, como influye todo esto en la capacidad de decisión del empresario con las consecuencias lógicas que ello tiene en la determinación del salario del trabajador.

Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
