La presente monografía trata de analizar aquellos aspectos más relevantes que se refieren a las medidas civiles que afectan a los hijos en los procedimientos de nulidad, separación, divorcio o ruptura de la convivencia de sus padres, cuando se producen situaciones de violencia de género o de conflictividad familiar intensa. Cuestiones tales como la privación de la patria potestad o suspensión de la misma al padre maltratador, la guarda y custodia de los hijos, el régimen de relación con el progenitor no custodio y con otros parientes y allegados, la atribución del uso y disfrute de la vivienda familiar y la pensión de alimentos son abordadas teniendo en cuenta la jurisprudencia vertida por nuestros Tribunales en estos más de diez años desde la entrada en vigor de la Ley Orgánica 1/2004,de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género, en orden a concretar cómo se protege «el interés superior del menor» en estos casos. Además, se analizan las nuevas reformas legales que se han producido y que implementan el marco legal de protección del menor, víctima de esta violencia. Entre ellas, la Ley 4/2015, de 27 de abril, del Estatuto de la Víctima del Delito y las leyes de modificación del sistema de protección ala infancia y a la adolescencia (LO 8/2015, de 22 de julio y la Ley26/2015, de 28 de julio). Virginia Múrtula Lafuente es Profesora Titular de Derecho Civil de la Universidad de Alicante. Es autora de diversas monografías y artículos relacionados con distintas parcelas del Derecho Privado. En particular, cabe destacar sus monografías La prestación de intereses (1999) y La protección frente a las cláusulas abusivas en préstamos y créditos (2012) en materia de Obligaciones y Derecho de consumo, respectivamente.
