Sin persona no hay Derecho. La persona es el fundamento del Derecho y de todo el orden jurídico, lo cual equivale a afirmar que el saber jurídico supone, o se apoya, en un conocimiento de la persona. Por eso comenzamos el estudio de la persona como sujeto del Derecho por un acercamiento antropológico a su naturaleza, a su propio ser. En estos primeros capítulos vamos a preguntarnos qué es el hombre. Haremos un brevísimo repaso de las principales respuestas que se han dado a esta pregunta a lo largo de la historia y ofrecemos, con más detalle, la concepción antropológica que consideramos ajustada a la realidad: el hombre como unidad dual. A continuación, abordaremos dos grandes consecuencias del ser del hombre: su dignidad y la ley natural. Por una parte, la dignidad de la persona es excelencia o eminencia en el ser, colocada al ser humano en un orden superior a lo demás seres y lo hace merecedor de respeto incondicional. Por otra parte, la dignidad de la persona es exigente, contiene un debe ser, porque la persona es un ser de fines que tiende a la perfección. La ley natural es el conjunto de exigencias que se derivan de la naturaleza humana, la primera y primordial expresión jurídica de la dignidad humana.
