El presente ensayo, que tiene su origen en la primera ponencia presentada en el Foro de Debate Jurídico Reus, tiene por objeto acreditar que la propiedad inmueble tiene un ámbito tridimensional, abarcando, además de la superficie terrestre delimitada mediante una línea poligonal, el vuelo y el subsuelo que están encima y debajo de la dicha superficie en la extensión que convenga al interés del propietario, que puede ser actual y futuro, patrimonial y extrapatrimonial, de afección incluso, interés que se presume y no ha de probar éste. Sobre esas bases, se analizan una serie de supuestos de pretendida y no plausible utilización indiscriminada y gratuita del vuelo ajeno por drones o grúas, analizándose, también, una serie de limitaciones del dominio en el ámbito vertical resultantes de las normas urbanísticas, relativas a la navegación aérea, a la energía eléctrica y a la telefonía, para terminar identi?cando una serie de supuestos, criticables, de abuso del derecho del propietario del subsuelo o del vuelo. El autor, Carlos Rogel Vide, Doctor en Derecho por la Universidad de Bolonia, es catedrático de Derecho civil en la Facultad de Derecho de la Universidad Complutense de Madrid. De la Academia de Pavía, es director de la Revista General de Legislación y Jurisprudencia y de diversas colecciones de la Editorial Reus, habiendo escrito numerosos libros y artículos en materias propias de la disciplina que profesa.
