La notion de contrat de travail précaire recouvre une large palette de contrats : contrat à durée déterminée, contrat de travail temporaire, contrats de travail aidés de la politique de l'emploi. Malgré leur diversité, l'évolution contemporaine du droit des contrats de travail précaires se caractérise par une harmonisation de leur régime juridique. Celle-ci s'opère de deux manières. D'une part, par un alignement sur le contrat à durée déterminée, comme instrument de stabilité de la relation de travail en faveur du salarié. D'autre part, par un alignement sur la rupture du contrat à durée indéterminée, comme instrument de sanction de l'emploi précaire. Le législateur a en effet élaboré une sanction tout à fait originale des contrats de travail précaires irréguliers ou injustifiés, la requalification du contrat en contrat à durée indéterminée. Etendue par le juge aux contrats aidés de la politique de l'emploi, la requalification-sanction suscite un abondant contentieux.
