Le droit pénal international établit les règles permettant à une justice pénale nationale de s'accomplir malgré la séparation politique et territoriale des États. Il détermine ainsi la compétence des lois pénales nationales, précise les modalités de la coopération judiciaire et fixe les effets qu'il est permis de reconnaître à des décisions pénales étrangères. Ultérieurement la matière s'est augmentée du droit des crimes de droit international (génocide, crimes contre l'humanité, crimes de guerre, crime d'agression, torture et crime de disparition forcée), définissant leurs éléments constitutifs et leur régime répressif. Ce Précis étudie ces deux composantes du droit pénal international.
