Community Restorative Justice (CRJ) is a process based in the community in which low level crime and anti-social behaviour is addressed through mediation. CRJ schemes are voluntary and funded by charitable sources with no formal regulation and have operated in Northern Ireland since 1996 under two main umbrella organizations: Northern Ireland Alternatives (based mainly in loyalist areas); Community Restorative Justice Ireland (based predominantly in republican areas). Both schemes emerged in response to a growth in "punishment attacks" carried out by republican and loyalist paramilitary organizations on young people who had allegedly engaged in anti-social behaviour. The schemes were therefore to provide a non-violent alternative through restorative justice activity. The work of CRJ schemes also involves the resolution of neighbourhood and family disputes, along with diverting young people from offending behaviour, as well, as crime prevention. The Northern Ireland Affairs Committee has set out a number of conclusions and recommendations, including: cooperation between the police (PSNI) and the CRJ schemes is important, but the Committee is disappointed that CRJ Ireland has decided not to formalize its relationship with the police by signing up to the draft Protocol (which proposes that an advisory panel be established to discuss the suitability of cases); the Committee welcomes the Minister's assurance that the non-criminal aspects of CRJ schemes, which make up the majority of their workloads, will be subject to proper inspection by the Chief Inspector of Criminal Justice; the Committee commends the extremely valuable work being carried out by CRJ schemes in local communities and their cost-effectiveness; following the Chief Constable's observation that areas lacking CRJ schemes were at a disadvantage, the Committee believes that the whole of Northern Ireland would benefit; ensuring that CRJ schemes are staffed by suitable individuals with no current paramilitary connections is crucial in building confidence; the Government should hold discussions with the PSNI and PPS (Public Prosecution Service) on the practical operation of all aspects of the referral process from the CRJ schemes, so that the benefit of delivering a swift, efficient and fair outcome for victims and offenders is achieved.

The Northern Ireland Affairs Committee today publishes its report on the Consultative Group on the Past in Northern Ireland Report (HCP 171, session 2009-10, ISBN 9780215542687). This report concludes the Committee's inquiry into the feasibility of implementing the proposals made in the Report of the Consultative Group on the Past in Northern Ireland. The Committee reached the following conclusions, including: that Northern Ireland has not yet reached a consensus on how to move on from its recent past; also, it is not clear that Northern Ireland needs a Legacy Commission when bodies such as the Victims and Survivors Commission and the Historical Enquiries Team are already dealing in different ways with aspects of the legacy of the Troubles; that healthcare services, particularly mental health services, for those affected by the Troubles are under strong pressure; that any future Legacy Commission should be chaired, or co-chaired, by figures from Northern Ireland rather than by a foreign figurehead; that the Northern Ireland Assembly, rather than the UK Government, should ultimately be responsible for decisions on how to fund a Legacy Commission - and therefore on the width of its remit; and that clarification is required on what role the Irish Government would play in setting up such a Commission, and in particular on what financial contribution it would be expected to make.
