La ricerca, infatti, focalizza il confronto sui formanti delle due più attive Corti regionali, la Corte EDU e la Corte interamericana dei diritti umani. Attraverso di esso, si dà conto non solo degli aspetti strettamente normativi, ma anche delle contingenze fattuali delle singole fattispecie e delle diversità contestuali e procedurali in cui i due organi operano, presupposti indefettibili per rendere la comparazione più funzionale all’individuazione di un possibile “nucleo comune” del best interests of the child. Dalla lettura organica del materiale giurisprudenziale emerge, inoltre, il paradosso solo apparente delle divergenze interpretative, in quanto la presenza di ermeneutiche differenti – sia sul piano diacronico che sincronico – si rivela essere, prima ancora che assolutamente compatibile con la fisiologica essenza del principio, probabilmente persino necessaria per l’individuazione, case by case, del “bene” del singolo minore.
