Updated as of May 29, 2018 Under the Clean Air Act (CAA or "Act"), EPA is granting requests by the State of California to reclassify the following four areas designated as nonattainment for the 1997 8-hour ozone national ambient air quality standard (NAAQS): The San Joaquin Valley area from "serious" to "extreme," the South Coast Air Basin area from "severe-17" to "extreme," and the Coachella Valley and Sacramento Metro areas from "serious" to "severe-15." In connection with the reclassifications, EPA is setting a deadline of no later than 12 months from the effective date of reclassification for submittal of revisions to the Sacramento Metro area portion of the California State Implementation Plan (SIP) to meet the additional new source review (NSR) requirements for "severe-15" 8-hour ozone nonattainment areas. EPA is deferring the setting of a submittal deadline for certain fee rules under section 185 of the CAA. A number of Indian tribes have Indian country located within the boundaries of the affected areas. The State of California is not approved to administer any CAA programs in Indian country, and the relevant Indian tribes have not applied for eligibility to administer programs under the CAA for their areas. In these circumstances, EPA implements relevant reclassification provisions of the CAA in these Indian country areas and is reclassifying these areas, except Indian country pertaining to the Morongo Band of Mission Indians ("Morongo Tribe") and the Pechanga Band of Luiseño Mission Indians ("Pechanga Tribe"), in keeping with the classifications of nonattainment areas within which they are located. EPA is deferring the reclassification of Indian country pertaining to the Morongo and Pechanga Tribes pending EPA's final decisions on their previously-submitted boundary change requests. In connection with this final action, EPA notified the affected tribal leaders and consulted with interested tribes. Transportation conformity is required under the Clean Air Act (CAA) Section 176(c) to ensure that Federally-supported transportation activities are consistent with (“conform to”) the purpose of a State Implementation Plan (SIP). Transportation conformity establishes the framework for improving air quality to protect public health and the environment. Conformity to the purpose of the SIP means Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) funding and approvals are given to highway and transit activities that will not cause new air quality violations, worsen existing air quality violations, or delay timely attainment of the relevant air quality standard, or any interim milestone. This Guide was prepared to help State and local officials understand transportation conformity and how conformity requirements relate to transportation investments in their communities. Specifically, the implications of conformity on metropolitan transportation plans, transportation improvement programs (TIPs), and transportation projects are discussed. The Guide provides overview information on the major elements of the conformity process and provides answers to basic questions. Several exhibits are included in the Guide to illustrate key elements of the conformity process. Appendices are also included that discuss the health effects of pollutants, options to reduce on-road mobile source emissions, and resource agency contacts.

A major section of the Clean Air Act Amendments (CAAA) focuses on reducing air pollution through extending and modifying the provisions for states and localities with US Environmental Protection Agency (EPA)-designated non-attainment areas. Specifically, Title 1 of the CAAA is concerned with non-attainment areas, as defined relative to the National Ambient Air Quality Standards for atmospheric ozone, carbon monoxide, and particulate matter; Title 2 is concerned with mobile sources or air pollution, which produce carbon monoxide, contribute to ozone concentrations, and in the past have been a major source of airborne lead; and Title 4 is concerned with acid deposition, mainly due to sulfur dioxide emissions. This paper has its origin in the question of the potential benefits for minorities--relative to the majority non-Black, non-Hispanic population--of reductions in air pollution that may result from these amendments. It is part of a larger effort to identify and assess the costs and benefits of the CAAA for minorities, relative to the majority population. The focus of this paper centers on comparing Black and Hispanic populations to White, non-Hispanic populations living in EPA-designated non-attainment area counties in the contiguous United States, which excludes Alaska and Hawaii. Subsequent comparisons of majority populations with Native Americans and Asian-Americans will include these two states.
