Un mercado de la electricidad que funcione correctamente y garantice el suministro seguro de energía a unos precios competitivos resulta una pieza clave para el crecimiento y el bienestar de los consumidores de la Unión Europea. Para lograr esta finalidad la UE decidió abrir a la competencia al mercado de la electricidad de Europa y crear un mercado único europeo de la energía. El proceso de apertura ha modificado considerablemente el funcionamiento de los mercados, ha ofrecido nuevas oportunidades de mercado y ha dado lugar a la introducción de nuevos productos y servicios. En este sentido la progresiva introducción de la competencia provocó inicialmente un descenso de los costes de la energía en Europa en línea con las condiciones de mercado. Sin embargo, aunque se han hecho progresos, todavía no se han alcanzado los objetivos de apertura del mercado. A pesar de la liberalización del mercado interior de la energía, subsisten obstáculos a la libre competencia. Las subidas significativas de los precios de la electricidad, que no se explican exclusivamente por los mayores costes primarios del petróleo y las obligaciones de índole medioambiental, las reiteradas denuncias sobre los obstáculos a la entrada, el alto nivel de concentración empresarial y las limitadas posibilidades de elección para los consumidores suponen unos obstáculos significativos para el desarrollo del mercado europeo de la energía. Estas son las cuestiones que, en líneas generales, se abordan en el presente Libro desde una doble perspectiva, económica y jurídica, en el que se tratan de ofrecer soluciones a los diversos y complejos problemas con los que se enfrenta el Derecho de la Competencia en el sector eléctrico. En este sentido, por un lado, debe reafirmarse la labor fundamental que tiene encomendada el Derecho destinada a dotar de seguridad jurídica, certeza y claridad normativa a los distintos mecanismos y actores que se interrelacionan en el mercado eléctrico. Por otro lado, adquieren un gran protagonismo los aspectos económicos que inciden en el desarrollo y evolución del sector eléctrico y que deben interrelacionarse con los jurídicos para garantizar el buen funcionamiento de este mercado. Sin embargo, aunque se han hecho progresos, todavía no se han alcanzado los objetivos de apertura del mercado.
