Cette dépénalisation de la vie des affaires paraît contredire la généralisation de la responsabilité pénale des personnes morales. Mais peut-être assiste-t-on en réalité à un transfert de la responsabilité pénale de la personne physique vers la personne morale. C'est ce que pourrait confirmer plusieurs indices tels que l'interprétation jurisprudentielle extensive de certaines conditions de la responsabilité pénale des personnes morales et la circulaire de 2006, relative à l'entrée en vigueur de la loi de 2004. L'hypothèse mérite en tous cas d'être éprouvée dans diverses disciplines de la vie des affaires, en particulier, le droit des affaires bien sûr, mais aussi, le droit social, le droit de la bourse et le droit de la concurrence. C'est toute l'ambition du présent ouvrage, qui contient le texte des contributions présentées à Amiens lors d'un colloque organisé le 12 février 2009.

And, second, how should a defendant's family status be recognized, if at all, in a criminal justice system situated within a liberal democracy committed to egalitarian principles of non-discrimination? After surveying the variety of "family ties benefits" and "family ties burdens" in our criminal justice system, the authors explain why policymakers and courts should view with caution and indeed skepticism any attempt to distribute these benefits or burdens based on one's family status.
