Planning Act 2008

Planning Act 2008 PDF Author: U K Stationery Office
Publisher: The Stationery Office
ISBN: 9780105429081
Category : Architecture
Languages : en
Pages : 212

Book Description
Parts 1 to 8 of the Planning Act 2008 create a new system of development consent for nationally significant infrastructure projects. The new system covers certain types of energy, transport, water, waste water and waste projects. The number of applications and permits required for such projects is being reduced, compared with the position under current legislation. A major role in the new system is to be played by a new independent body to be called the Infrastructure Planning Commission ('the Commission'). The Commission will be responsible for examining applications for development consent for nationally significant infrastructure projects. National policy statements will set the framework for decisions by the Commission. The Secretary of State will have a wide discretion as to how prescriptive the policy should be. The Act sets out the procedures for examination of an application. It is intended that in examining applications greater use is made of written representations with less reliance on oral representations; and restrictions are being placed on the use of cross examination by interested parties at a hearing. The Act sets a timetable for examination of applications and decisions. A deadline of six months is stipulated for carrying out the examination procedure and a further three months is allowed for a Council (consisting of between five and nine Commissioners), a Panel or the Secretary of State to take a decision. Part 9 of the Act makes various alterations to the existing town and country planning regime. Part 10 adds certain matters within the field of town and country planning to the legislative competence of the National Assembly for Wales. Part 11 empowers the Secretary of State to establish a Community Infrastructure Levy.

The Law of Compulsory Purchase and Compensation

The Law of Compulsory Purchase and Compensation PDF Author: Michael Barnes KC
Publisher: Bloomsbury Publishing
ISBN: 1849467528
Category : Law
Languages : en
Pages : 660

Book Description
This book is a statement of the current law of compulsory purchase of land and compensation for that purchase. It covers all major aspects of the procedure for the compulsory acquisition of land and deals in full detail with all aspects of the law of compensation for such an acquisition. The many and diverse statutory provisions are organised into a series of chapters containing all principles and rules and there is a full analysis and explanation of the leading authorities on the subject and the principles derived from those authorities without which the subject cannot be understood. The aim of the book is, not only to explain the statutory provisions and to organise the various possible claims for compensation into different heads, but also to explain and analyse the substantial body of case law which has built up, particularly in recent years, and the relationship between that body of law and the underlying statutory provisions. The book also attempts to explain the purpose of the statutory provisions and the reason for the rules that are derived from the authorities. Chapters of the book are devoted to the procedure for formulating and pursuing a claim for compensation and to the valuation principles which must be applied in advancing claims. An Appendix is provided by Mr Nicholas Eden FRICS, a leading valuer in the field, which contains examples of different types of compensation valuation with annotations as to how the valuations are prepared and built up. A further aim of the book is to provide, where possible, practical advice to public authorities and landowners involved in the process of compulsory purchase and compensation as well as to explain the legal principles.

The Rules of Project Risk Management

The Rules of Project Risk Management PDF Author: Robert James Chapman
Publisher: Routledge
ISBN: 1000650502
Category : Business & Economics
Languages : en
Pages : 455

Book Description
The Rules of Project Risk Management, 2nd Edition, provides practical experience-based guidance to support the delivery of effective project risk management. While the discipline is recognised as a major contributor to the successful outcome of projects, its implementation is far from straightforward. Successful delivery requires an in-depth understanding of the "ingredients" of effective risk management practices which impact project performance. The book’s value is derived from the description of these ingredients in a manner which will support their practical implementation. The author describes a series of guidelines (labelled "rules") to support the practical application of project risk management to positively influence project outcomes. The rules are supported by mini case studies of both successful and unsuccessful projects to bring to life the ramifications of effective and poor risk management respectively, and are assembled under seven headings of environment, external stakeholders, organisation and culture, leadership and governance, internal stakeholders, risk resources and system. This second edition contains a new glossary of terms and an overview of the risk management process to enable those new to the subject to understand the core risk management activities. It also contains six more individual guidelines and ten more case studies to support practitioners, researchers and academics alike to gain an even greater appreciation of the drivers of successful project risk management. Enabling the reader to "get inside" risk management to gain an appreciation of the individual components and "how the engine works", this book is essential reading for project and risk management professionals. While the guidelines are described individually so specific subjects can be examined in detail, they must be considered together, for like a car, specialist carburettors, fuel injection or high-octane fuel on their own do not support improved performance. The guidelines can be considered as the elements that should be taken into account when compiling a risk maturity model to drive incremental improvement in risk management practices.
