Los espacios y servicios públicos de una ciudad han de cumplir unos principios en su diseño y funcionamiento, desde el punto de vista de la seguridad para estacionamientos, áreas residenciales, paradas de autobús y para el entorno urbano en general. Los cuerpos y fuerzas de seguridad deben contribuir a mantener la seguridad en todas esas infraestructuras.

A lo largo de estas páginas hemos trazado un panorama de aquello que puede entenderse como seguridad en el momento actual. Partiendo de los conceptos constitucionales asociados a la misma: el orden público; la seguridad ciudadana como garantía de derechos, pero también como un derecho prestacional de los ciudadanos y un correlativo deber de la Administración Pública; y, finalmente, habríamos delimitado la seguridad pública como el conjunto de las políticas públicas de seguridad más allá de la mera competencia exclusiva estatal del artículo 149,1,29 CE. Correlativamente, se habría analizado el fenómeno de la inseguridad desgranado la mazorca de factores que se aúnan para dar lugar a la inseguridad. En efecto, se trata de nalizar los profundos cambios que las sociedades occidentales han experimentado, en tanto que Estados sociales y democráticos de Derecho de finales del siglo XX y de inicios del siglo XXI, configurando una preocupación por la inseguridad percibida, subjetiva, más que por la de carácter objetivo. Y esa inseguridad tendría un campo de cultivo abonado en las ciudades y, más concretamente, en sus espacios públicos. En el marco de la teorización de la inseguridad, se ha realizado un repaso a las teorías criminológicas surgidas en el mismo período de finales del s. XX y principios del s. XXI, deteniéndonos, entre otras, en la criminología crítica, left realism, Broken Windows, situational prevention, la teoría de la acción rutinaria (con su antecedente la economical aproach) o, finalmente, el conjunto de técnicas conocidas como Crime prevention through environmental design (CPTED). El conjunto de éstas teorías hipótesis doctrinales habrían alumbrado una seguridad descentralizada en los municipios, y, finalmente, la promulgación de normativas reguladoras de conductas que tendrían, una fuerte orientación hacia la protección del espacio público y también del medio ambiente urbano (suciedad, ruidos, grafitis...). Finalmente, la tesis se centra en la recepción española de este tipo de normas de regulación de comportamientos desordenados a través de de las llamadas ordenanzas de civismo y convivencia. Estas normas no son un ejemplo aislado en Europa, ya que cuentan con antecedentes europeos, ya sea con carácter más general (es el caso de la Crime and Disorder Act) o con carácter estrictamente local como los arrêtés municipales franceses (de larga tradición en el Derecho francés), la Street Wise de Amsterdam o, con naturaleza contemporánea a las ordenanzas españolas, los decretos que il pachetto sicurezza habilita a los alcaldes italianos para regular las conductas desordenadas en el ámbito de la sicurezza urbana. Tanto en el caso francés como en el italiano, nos encontraríamos con el uso de normas de carácter administrativo, instrumentos típicos de policía administrativa, para hacer frente a la inseguridad y esta sería una deriva remarcable de las nuevas políticas de seguridad: la substitución de normas de carácter penal por normas administrativas. Cuestión a la que deberemos estar especialmente atentos por lo que eventualmente pueda implicar de disminución de las garantías de los ciudadanos.
