Contratto di lavoro e vita privata sono termini che identificano due ambiti apparentemente ben distinti dell’esistenza della persona. Solo apparentemente però. Perché la persona che lavora è pur sempre una realtà unitaria. Da ciò deriva che la linea di confine tra le due sfere appena menzionate può seguire in concreto traiettorie differenti, lungo le quali si pongono molteplici problemi giuridici. Alcuni di essi sono oggi amplificati in misura notevole dal progresso tecnologico. Altri sono antichi come il diritto del lavoro e, forse, anche più. Il libro si interroga su queste tematiche, cercando di rintracciare nel materiale normativo esistente delle coordinate sistematiche che possano utilmente orientare gli interpreti. L’analisi della disciplina dei controlli e delle indagini che il datore di lavoro può effettuare nei confronti dei dipendenti consente di riflettere sui profili di possibile contrasto tra gli interessi organizzativi e produttivi dell’impresa e le esigenze di libertà del lavoratore. Ciò permette, a sua volta, di valutare anche la perdurante idoneità della costruzione contrattuale del rapporto di lavoro a indirizzare l’indagine giuridica verso l’individuazione di adeguati punti di equilibrio.
