Il volume aggiorna “Tipologie contrattuali e disciplina delle mansioni” in relazione alle sole discipline sui contratti di lavoro subordinati, arricchendosi di una ragionata analisi sui contratti di lavoro autonomo. Il primo capitolo è dedicato alla disciplina del lavoro a tempo parziale, analizzata con particolare attenzione alle flessibilità temporali, nell’intreccio tra disciplina legale e collettiva, e al part-time ‘scelto’; questioni che incidono sul delicato equilibrio tra le esigenze di flessibilità delle imprese e la garanzia, per le lavoratrici e i lavoratori, di posizioni soggettive di rilevanza costituzionale. Il capitolo secondo analizza il lavoro intermittente, soffermandosi sulle numerose questioni dibattute: l’esistenza di una duplice tipologia; la natura del rapporto di lavoro in assenza di obbligo di disponibilità; l’incertezza della tutela di carattere lavoristico costretta a modellarsi in base all’alternanza tra periodi di lavoro e periodi di non lavoro. Il terzo capitolo è incentrato sulle regole che governano l’utilizzo del contratto a tempo determinato, frutto di modifiche legali contraddittorie, evidenziandone criticità e prospettive evolutive anche in chiave applicativa e si conclude con l’esame della disciplina vigente nel lavoro pubblico contrattualizzato. Il capitolo quarto ha ad oggetto la somministrazione di lavoro che è stata più volte modificata con interventi normativi anche di segno opposto: dalla liberalizzazione varata con il Jobs Act del 2015 ai vincoli introdotti con il c.d. decreto dignità del 2018 che rendono la disciplina vigente complessa e densa di numerose questioni teoriche ed applicative. Il quinto capitolo analizza la disciplina del contratto di apprendistato, approfondendo le molteplici questioni interpretative esistenti, anche in considerazione delle molteplici fonti regolative legittimate ad operare. La limitata diffusione dell’istituto induce a dedicare cenni pure ai limiti della regolamentazione: quella che concerne il contratto di apprendistato, come quella invece rivolta all’insieme dei contratti di lavoro flessibili. Il sesto capitolo affronta la vicenda del lavoro occasionale, attraversata da una serie di riforme nell’arco di un decennio, sino all’abrogazione e alla sua successiva re-introduzione con un nuovo assetto normativo, che ne evidenzia uno sviluppo tutt’altro che trascurabile nel mercato del lavoro italiano e nella realtà economica. Il settimo ed ultimo capitolo, esamina la disciplina delle collaborazioni autonome che, nelle diverse forme delle collaborazioni etero-organizzate e delle collaborazioni coordinate e continuative, ha posto rilevanti questioni interpretative ed applicative. Il contributo fornisce una sistemazione concettuale delle diverse categorie del lavoro autonomo, identificandone le caratteristiche tipologiche e le relative discipline.
