Constitutional Doctrines of Webster, Hayne and Calhoun (Classic Reprint) PDF Author: Daniel Webster

ISBN: 9781331036685
Category : Political Science

Book Description
Excerpt from Constitutional Doctrines of Webster, Hayne and Calhoun The attention of Normal instructors, Superintendents and Teachers is invited to the peculiar educative value of the American History Leaflets series when used for supplementary reading and reference as adjuncts to the regular text-book in United States history. The matter comprised in the Leaflets consists of reprints of famous documents that were the mainspring of political action, or the resultants of such activity. The American History Leaflets are thus of great value for giving that particularity and local color to the important events of our history which the limited space of most text-books forbids. Pupils using them will thus obtain a more intelligent idea of the epoch under consideration. The American History Leaflets are issued under the editorial supervision of Albert Bushnell Hart and Edward Channing, Professors of American History in Harvard University, and each number contains an Introduction by the Editors, with a bibliography for use in further investigation. Book Description
Excerpt from Letter to the Hon. Daniel Webster, on the Compromises of the Constitution Since God created man, when and where did there ever exist on the face of the earth a people whose average intellectual and moral elevation excelled that of the people of Massachusetts of the present day? And yet Massachusetts, as a Commonwealth, conspicuously takes the lead in all those progressive and reformatory measures which are so incompatible with the extension, and even the existence of slavery; and, in their effects, so disturbing and so alarming to the pro-slavery interest of the Union. Daniel Webster and the Unfinished Constitution

Daniel Webster and the Unfinished Constitution PDF Author: Peter Charles Hoffer
Publisher: University Press of Kansas
ISBN: 070063200X
Category : Law
Languages : en
Pages : 292

Book Description
Daniel Webster and the Unfinished Constitution reveals Webster as the foremost constitutional lawyer of his day. Peter Charles Hoffer builds a persuasive case that Webster was more than a skilled practitioner who rose rapidly from his hardscrabble New Hampshire origins. Hoffer thoroughly documents the ways in which Webster was an innovative jurist. While Chief Justice John Marshall gets credit for much of our early constitutional jurisprudence, in fact in a series of key cases Marshall simply borrowed Webster’s oral and written arguments. For Webster, Marshall, and many lawyers and jurists of their day, professions of adherence to the Constitution were universal. Yet they knew that the Constitution could not be fixed in time; its text needed to be read in light of the rapidly transforming early republic and antebellum eras or it would become irrelevant. As Chief Justice Marshall explained in Bank of the United States v. Deveaux (1809): “A constitution, from its nature, deals in generals, not in detail. Its framers cannot perceive minute distinctions which arise in the progress of the nation, and therefore confine it to the establishment of broad and general principles.” But were these “broad and general principles” themselves fixed? For Webster there were landmarks: the Contract Clause and the Commerce Clause. While others were exploring and surveying the Northwest Territory and the Louisiana Purchase, Webster set out to map the spaces in the constitutional and legal landscape that were unmarked. Peter Charles Hoffer provides an insightful and timely study of how Webster’s analysis of three key constitutional issues is relevant to today’s constitutional conflicts: the relationship between law and politics, between public policy and private rights, and between the federal government and the states, all of which remain contentious in our constitutional jurisprudence and crucial to our constitutional order.

Book Description
Excerpt from Principles of the Constitutional Law of the United States This volume is an abridgment of the author's larger treatise in two volumes, published in 1910 under the title The Constitutional Law of the United States. The aim has been to present the general principles of our constitutional jurisprudence in a form suitable for class-room use. In pursuance of this aim care has been taken to cite those cases which not only support the positions stated in the text but which Will best repay individual examination and study by the student. In particular the effort has been made to suggest, and in a measure to discuss, the unsettled questions of our Federal jurisprudence. The necessary limits of space have prevented in many instances an adequate presentation of the arguments supporting the doctrines stated, but, from a pedagogic point of view this may be a merit rather than a defect, for it will furnish opportunity for a presentation by the students of the court's reasoning as gained by a reading of the cases, and a criticism by the instructor of the reasoning as thus pre sented.
