Book Description
Without actually advocating it, scholars from South Africa suggest the high probability that some form of federalism will emerge from the process of remaking that country after the demise of minority rule. They discuss such topics as the role of and challenges to the African National Congress, contending views of the economy, interactions between local bargaining and national- level political negotiations, and the place of the new country in a larger world that is changing nearly as rapidly. The 15 studies were presented at a 1991 conference in Leicester, England. Distributed in the US by St. Martin's Press. The CIP shows the title incorrectly. South Africa
Author: Siri Gloppen
Publisher: Routledge
ISBN: 0429627238
Category : Law
Languages : en
Pages : 306
Book Description
Originally published in 1997, South Africa: The Battle over the Constitution analyses rivaling positions in the South African constitutional debate from the early 1990s, via the 1993 interim constitution to the adoption and certification of the new, 'Final' Constitution in December 1996. A theoretical framework is developed to analyze the constitutional structure of the contesting constitutional models and the book looks into their potential for addressing the problems of violence, social inequality and ethnic tension and for achieving legitimacy and constitutionalism. It argues that the constitutional 'solutions' are premised on incomparable conceptions of South African reality, and that the Final Constitution includes elements based on incompatible world-views. The compromises required by the 'constitutional moment' could pose problems for the ’constitutional function’. The book also discusses other factors influencing the consolidation of a constitutional democracy in South Africa, such as the role of the Constitutional Court and the attempts to create legitimacy for the constitution by broad public participation in the constitution-making process.

Ethnic Diversity and Federalism
Author: Yonatan Tesfaye Fessha
Publisher: Routledge
ISBN: 1317140982
Category : Law
Languages : en
Pages : 311
Book Description
How federalism can be used to provide recognition and accommodate ethnic groups is an important topic, not only in Africa, but in multi-ethnic communities around the world. Examining how institutions of multi-ethnic states have been designed to accommodate ethnic diversity while at the same time maintaining national unity, this book locates institutional responses to the challenges of ethnic diversity within the context of a federal arrangement. It examines how a federal arrangement has been used to reconcile the conflicting pressures of the demand for the recognition of distinctive identities, on the one hand, and the promotion of political and territorial integrity, on the other. Comparative case studies of South Africa and Ethiopia as the two federal systems provide a contrasting approach to issues of ethnic diversity. Suggesting new ways in which federalism might work, the author identifies key institutions lessons which will help to build an all-inclusive society.
