Law and Democracy in Contemporary India

Law and Democracy in Contemporary India PDF Author: Tatsuya Yamamoto
Publisher: Springer
ISBN: 3319958372
Category : Political Science
Languages : en
Pages : 222

Book Description
This book analyses legal orders, actors and democracy in contemporary India, with a particular focus on the everyday contexts and dynamics of human rights, citizenship and socio-economic rights and laws. The contributions explore both ‘institutionalization from above’, where the judiciary and legislative body aim to govern people, and ‘institutionalization from below’, where the governed attempt to expand their substantive rights embedded within their everyday lives. This analysis identifies contact zones between the two directions, which act as spaces for democratic participation and negotiation. Such a perspective should be useful to both those who are interested in Indian politics, and anthropologists and sociologists working on dynamics of laws and rights.

The Indian Parliament

The Indian Parliament PDF Author: B.L. Shankar
Publisher: Oxford University Press
ISBN: 019908825X
Category : Political Science
Languages : en
Pages : 361

Book Description
The Parliament is the visible face of democracy in India. It is the epicentre of political life, public institutions of great verve, and a regime of Rights. In a first-of-its-kind study, this book delves into the lived experience of the Indian Parliament by focusing on three distinct phases—the 1950s, the 1970s, and the 1990s and beyond. The authors argue against the widely held notion of its ongoing decline, and demonstrate how it has repeatedly, and successfully, responded to India's changing needs in six decades of existence. This comprehensive and authoritative study examines the changing social composition and differing modes of representation that make up the Lok Sabha and critically explores its relation with the Rajya Sabha. Developments in the institutional complex of the Parliament, including the functioning of the Opposition and the Speaker are traced over time, along with the processes of legislation and accountability. Major debates in the House are scrutinized, and much of the analysis is based on empirical data gathered from surveys circulated among prominent politicians and public intellectuals. It also addresses the intricate issue of relations between the Judiciary and the Parliament. In its in-depth focus on the Lok Sabha, the volume highlights the way the Parliament has come to encompass India's proverbial diversity. It especially demonstrates the route this institution has taken to engage with fractious issues of diverging linguistic and regional demands.

Extracts from Opinions of Author's Earlier Book. "I am happy to find in your book such well documented and argued support for a proposal which I have advocated for many years." Shri J. R. D. Tata Eminent Industrialist "My own personal opinion that a success of any system, be it parliamentary or presidential, ultimately depends on the people who will operate it, has changed after having read your book...Your book is bound to contribute a great deal in moulding the public opinion in this regard." Shri Babubhai Patel Ex-Chief Minister of Gujarat "I really enjoyed the discussion we had on your views… and analysis of the Presidential System. Frankly, after listening to your meticulous analysis of the comparative merits, I must say I am veering around to your view... I am convinced that your objective is a pure one and is not aimed at pursuit of any political gains but to the promotion of a nationalist ideology. I am pleasantly amazed that our country still has persons like you. You have no personal ambitions in the matter. It is indeed gratifying that a highly qualified Engineer and Technologist like you should be taking such great interest in promoting a larger national cause. You have taken up this agenda of political reforms with no other expectation than good of the country at large." Shri M. N. Venkatachaliah Former Chief Justice of India and Chairman, Constitutional Reforms Committee, Govt. of India, 2002 "Your lifetime of work for the cause of bringing the presidential system to India is an important contribution to the future of our country. You have given this mission your best for a very long time. I am touched and encouraged… Please don't give up hope… You are (a) source of inspiration..." Constitution, Government and Politics in India

Constitution, Government and Politics in India PDF Author: Biswaranjan Mohanty
Publisher:
ISBN:
Category : History
Languages : en
Pages : 620

Book Description
ABOUT THE BOOK Before 1947, India was a dependency of the United Kingdom and consisted of British India, and the Princely States. It encompassed the entire area which now forms the four countries of India, Pakistan, Myanmar, and Bangladesh. India inherited a dismal economy from the British rulers at the time of Independence in 1947. Owing to poor technological and scientific capabilities, industrialization was limited and lop-sided. Agricultural sector exhibited features of feudal and semi-feudal institutions, resulting into low productivity. The political system was fragmented and the national unity was in danger. Various factors were responsible for political problems which were threatening the very existence of India as a nation. The Constitution of India adopted on November 26, 1949, became operative on January 26, 1950. It provides for two layers of Government, one at the Central level, and the other at the level of the States. A federal polity of this kind requires division of powers and responsibilities between the Centre and the States. Hence, the Constitution describes in detail the legislative powers and functions of the two tiers of Government. It is the fountain-head of all legislations. India, with a population of more than one billion, is the world?s largest democracy. Indian polity consists of three main branches, namely the executive, legislature and the judiciary along with subsidiary branches like political parties, statutory institutions etc. This book presents a comprehensive description and analysis of the constitution, system of government and dynamics of politics in India, a geographically and demographically vast country inhabited by people professing different religions, speaking a variety of languages and adhering to diverse socio-cultural ethos.
