Esta obra sobre el funcionamiento del arbitraje explica porqué éste no es excepcional ni inferior al Poder Judicial, aunque debe conservar ciertas propiedades que lo caracterizaron en su origen y que lo diferencian en su funcionamiento, particularmente la flexibilidad en la valoración de las pruebas y en el método de razonamiento jurídico, pero sin faltar rigurosidad científica. La obra analiza la funcionalidad operativa y práctica (aunque no exegética) del arbitraje sentando lineamientos traspolables a todas las jurisdicciones de Derecho Civil, contribuyendo a otorgar verdadera autonomía científica al arbitraje y sembrando las bases para el planteamiento de una aún incipiente teoría general e integral del arbitraje. La obra se contextualiza y hace referencia principal -aunque no solamente- al Derecho venezolano. Sin embargo, al ser una de sus premisas fundamentales que el arbitraje debe apoyarse en aproximaciones no positivistas sino iusnaturalistas e historicistas para el razonamiento jurídico, sus conclusiones deben considerarse vigentes con verdadera observancia transnacional.
