En matière de protection du patrimoine en cas de conflit armé, plusieurs instruments existent : convention UNESCO de 1954 sur la protection des biens culturels en cas de conflit armé, conventions de La Haye (1899 et 1907) et conventions de Genève de 1949 faisant référence à la protection des biens culturels, convention UNESCO de 1970 incitant les Etats parties à prendre des mesures pour lutter contre le trafic illicite de biens culturels, etc. Face à la situation récente en Irak et en Syrie (destruction, pillage et trafics illicites), plusieurs résolutions, décisions et règlements ont par ailleurs été adoptés par le Conseil de sécurité des Nations-Unies, l'UNESCO ou l'Union européenne. La mise en oeuvre de ces différents dispositifs se heurte toutefois à de grandes difficultés, inhérentes au droit international et à la situation politique des pays en crise ou en guerre. C'est dans ce contexte que M. Jean-Luc Martinez, Président-directeur du musée du Louvre, a été chargé par le Président de la République, d'une mission visant à renforcer la protection du patrimoine dans les zones de conflit.

This book explores the objects, means and ends of international cultural heritage protection. It starts from a broad conception of cultural heritage that encompasses both tangible property, such as museum objects or buildings, and intangible heritage, such as languages and traditions. Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was successful , immigrants and ethnic minorities are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence.
