Since publication of that earlier guidance document, several significant events have occurred that affect the reporting obligations of facilities owned or operated by the Department of Energy (DOE), including the publication of Executive Order 12856--Federal Compliance with Right-to-Know Laws and Pollution Prevention Requirements--and a rejection by the US Court of Appeals of EPA's interpretation of the term release into the environment. In preparing this guidance document, the Office of Environmental Policy and Assistance, RCRA/CERCLA Division (EH-413), has documented responses to queries from DOE field elements on CERCLA and EPCRA release reporting requirements, as well as incorporating those Questions and Answers from the previous document that remain germane to DOE's reporting obligations under CERCLA and EPCRA.
