Book Description
Opponents of U.S. and Canadian strike replacement legislation contend that restricting the use of strike replacements significantly alters bargaining power and increases strike activity. This article uses data on Canadian manufacturing collective-bargaining agreements to investigate these hypotheses. Although a general ban on strike replacements is found to be associated with longer strikes, little evidence is found to suggest that banning permanent strike replacements significantly influences strike incidence, strike duration, or negotiated wages.

The Effect of Collective Bargaining Legislation on Strikes and Wages
Author: Peter C. Cramton
Publisher:
ISBN:
Category : Collective bargaining
Languages : en
Pages : 48
Book Description
Using Canadian data on large, private-sector contract negotiations from January 1967 to March 1993, we find that wages and strikes are substantially influenced by labor policy. In particular, we find that prohibiting the use of replacement workers during strikes is associated with significantly higher wages, and more frequent and longer strikes. This is consistent with private information theories of bargaining. We estimate the welfare consequences of a ban on replacement workers, as well as other labor policies. Despite the higher dispute costs, union workers are better off with a ban on replacement workers. The higher wage more than compensates for the more frequent and longer strikes.

The Effect of Strike Replacement Legislation on Employment

Book Description
Employers and employer groups often argue that restrictions on an employer's ability to use replacement workers during a strike reduce employment. This study analyzes the effect of Canadian provincial strike replacement legislation on employment using province-level aggregate data for 1966-94 and private sector, bargaining unit-level disaggregated data for 1966-93. Three types of strike replacement statutes are analyzed: strike replacement bans that prohibit both permanent and temporary replacements, reinstatement rights for strikers (effectively banning permanent replacements), and restrictions on the use of professional strikebreakers. A strike replacement ban that restricts the use of both permanent and temporary replacements is found to have negative employment consequences. The results for reinstatement rights provisions and professional strikebreaker bans are mixed.

Book Description
We examine the effects of collective bargaining legislation, such as (among others) bans on replacement workers and reinstatement rights, on private sector strike activity and wage settlements using Canadian data from 1978 to 2008. Our estimates indicate that this legislation does not have a statistically significant effect on the incidence of strikes. However, we do find that some of the policy variables have a statistically significant effect on strike duration and wage settlements.
