The facts are set out fully in the following judgment given ing judgment given at the trial by Nov. 2, 1910. MATHERS, C.J.K.B.: --This is an action, tried before me at Brandon, in which the plaintiff seeks to recover damages for three horses killed on the railway company 's track. No witness who actually saw the horses killed by the defendants' train was produced, but, from all the circumstances, I have no hesitation in inferring that these animals were killed by the defendants' train and upon its railway track. It is admitted that where the animals reached the railway, the company was under no liability to fence under sub-section 4 of section 254 of the Railway Act. The plaintiff 's contention is that he is entitled to recover under sub-sections 4 and 5 of section 294. These sub-sections are as follows: --"4. When any horses, sheep, swine or other cattle at large, whether upon the highway or not, get upon the property of the company and are killed or injured by a train, the owner of any such animal so killed or injured shall, except in the cases otherWise provided by the next following section, be entitled to recover the amount of such loss or injury against the company in any action in any Court of competent jurisdiction, unless the company establishes that such animal got at large through the negligence, or wilful act, or omission, of the owner or his agent, or the custodian of such animal or his agent."
