This book studies the Sydney (Lidcombe) branch of Australia's CFMEU in an attempt to document and critique its branch level strategy in the year immediately after the removal of the Howard-Costello Government, i.e. November 2007 to November 2008. This 'transitional time', prior to the Rudd-Gillard Government releasing its own plans for workplace relations, was a time of excitement and anticipation in union offices and building sites across the country as people perceived that the balance of power between labour and capital had changed. However, industry participants remained unsure of exactly how far the new government would go in dismantling the repressive workplace laws of its predecessor. CFMEU strategy at the Sydney branch level revolved around a program of 'rebuilding influence' on the building sites. We also document CFMEU strategy in relation to immigrant worker issues, as revealed through several micro-cases, and offer some observations as to how effective the CFMEU's actions were in each case.

Between 1989 and 2013 every industry sector covered by the Transport Workers Union in New South Wales was utterly transformed by processes of globalisation and technological and market change. Large players consumed small firms; in turn, the bigger companies were often acquired by global players. The lesson that emerges from Organising Union is simple: the value of solidarity. In 2001 redundant Ansett workers were told they would never see their entitlements. In 2006 Tooheys owner-drivers were suddenly terminated by the company; the goodwill invested in their trucks and business was declared worthless. Ansett workers received almost all their entitlements—an unprecedented 95 cents in the dollar. The Tooheys drivers’ jobs were saved, the value of their goodwill upheld. Those outcomes were possible only because of the solidarity of transport workers and the support of their union. No one else stood alongside the workers at Ansett and Tooheys as consistently and tenaciously as their own union. Organising Union explores the relationship between the union and key industry players, and between the union and governments. The TWU has often been at the centre of controversy: the turbulent 1989 union election punctuated by accusations of rorts and fist fights; the clashes with the Hawke and Keating governments over the Accord and enterprise bargaining, resulting in the TWU disaffiliating from the ACTU and a truck blockade of the Reserve Bank’s Sydney headquarters; the devastating 2001 Ansett closure and the long industrial war with Qantas culminating in the dramatic 2011 airline shutdown; the struggle to achieve ‘safe rates’ for truckies against the resistance of employers and governments. In the face of these challenges solidarity—the strength of an organising union—has held the TWU together.

Most legal expert systems attempt to implement complex models of legal reasoning. But the utility of a legal expert system lies not in the extent to which it simulates a lawyer’s approach to a legal problem, but in the quality of its predictions and of its arguments. A complex model of legal reasoning is not necessary: a successful legal expert system can be based upon a simplified model of legal reasoning. Some researchers have based their systems upon a jurisprudential approach to the law, yet lawyers are patently able to operate without any jurisprudential insight. A useful legal expert system should be capable of producing advice similar to that which one might get from a lawyer, so it should operate at the same pragmatic level of abstraction as does a lawyer—not at the more philosophical level of jurisprudence. A legal expert system called SHYSTER has been developed to demonstrate that a useful legal expert system can be based upon a pragmatic approach to the law. SHYSTER has a simple representation structure which simplifies the problem of knowledge acquisition. Yet this structure is complex enough for SHYSTER to produce useful advice. SHYSTER is a case-based legal expert system (although it has been designed so that it can be linked with a rule-based system to form a hybrid legal expert system). Its advice is based upon an examination of, and an argument about, the similarities and differences between cases. SHYSTER attempts to model the way in which lawyers argue with cases, but it does not attempt to model the way in which lawyers decide which cases to use in those arguments. Instead, it employs statistical techniques to quantify the similarity between cases. It decides which cases to use in argument, and what prediction it will make, on the basis of that similarity measure. SHYSTER is of a general design: it can provide advice in areas of case law that have been specified by a legal expert using a specification language. Hence, it can operate in different legal domains. Four different, and disparate, areas of law have been specified for SHYSTER, and its operation has been tested in each of those domains. Testing of SHYSTER in these four domains indicates that it is exceptionally good at predicting results, and fairly good at choosing cases with which to construct its arguments. SHYSTER demonstrates the viability of a pragmatic approach to legal expert system design.
