Modifié par les lois du 20 juillet 1899 et du 5 avril 1937, ce régime est à présent inadapté. La loi est anachronique et les tentatives de la jurisprudence pour l'adapter se révèlent insuffisantes. Critiqué par les victimes et les enseignants, ce régime doit être abandonné. Les victimes tentèrent d'exploiter d'autres régimes, pour contourner celui de la loi du 5 avril 1937, mais aucun d'entre eux n'est pleinement satisfaisant. D'autres règles doivent donc être envisagées. Il faut rechercher un autre fondement pour engager la responsabilité civile de l'enseignant ou un autre débiteur que ce dernier, afin que les victimes d'accidents scolaires obtiennent facilement réparation."

Higher Education Leadership and Management have become increasingly important throughout the years due to the complexities that have to be addressed by universities worldwide. This can be seen not only in professionalisation in fields such as faculty management or in areas of quality assurance and internationalisation, but also in the need for exchange and training in academic leadership, such as that of deans or study deans, or of university leadership in general. The Dialogue on Innovative Higher Education Strategies (DIES) is addressing this need in emerging countries by building platforms of exchange and offering training courses.
