Book Description
Written by Stephen Gold, a civil and family judge, legal broadcaster and journalist, this self-help best-seller has been significantly expanded with over 25 new chapters added to make this a 77 chapter bumper second edition covering even more of the legal problems we may all encounter at some time in our lives. So whoever you are – litigant in person, consumer or business owner and you can even be a professional lawyer or legal trainee to derive benefit from the book - you will find entertaining and enormously practical advice, written in straightforward language, direct from the judge’s pen to help you succeed in your dispute - or at least lose well. Been overcharged at a supermarket? Overlooked in a relative’s will? Sold duff goods? Sued for repossession by mortgage lender or landlord? Threatened by being left penniless after a divorce? You can find help here. But now in this second edition, you will also be armed to challenge that parking ticket, cope with a speeding or drink-drive prosecution, get your money back on a Covid cancelled holiday, resist excessive service charges from your landlord and much, much more. And Breaking Law Iooks like being the first book available to cover the new no-fault divorce laws that are due to come into force in April 2022. But Stephen does much more than explain rights. He takes you through how to behave in court (including how to cross-examine) whether it’s a face-to-face or remote hearing. And the book is full of templates: letters to help you win without a court case; documents you can use if the dispute goes to court; and documents such as the change your name deed, the cohabitation agreement, the pre-nuptial agreement, the anti-gazumping agreement, the no-sex agreement and the longest will in the world from which you can chose who inherits and who doesn’t. Throughout, Stephen’s advice is illuminated by tales of how his own disputes with a myriad of businesses have gone. No disputes with the twins Ron and Reg Kray, though. He was their lawyer and there’s a fascinating account of his professional relationship with them and his discovery of what became of Ron’s brain. If you do think you need a lawyer, Stephen provides plenty of ideas of how to get legal advice before handing over any money along with how to source professional help in and out of courts and tribunals for those who cannot afford legal fees (and who can?!). From the moment you get out of bed, you could suddenly find yourself needing this book. So don’t wait till the worst happens, get a copy and keep it handy like thousands of others have done over the last five years.

When Governments Break the Law

When Governments Break the Law PDF Author: Austin Sarat
Publisher: NYU Press
ISBN: 0814741428
Category : Political Science
Languages : en
Pages : 242

Book Description
Recent controversies surrounding the war on terror and American intervention in Iraq and Afghanistan have brought rule of law rhetoric to a fevered pitch. While President Obama has repeatedly emphasized his Administration’s commitment to transparency and the rule of law, nowhere has this resolve been so quickly and severely tested than with the issue of the possible prosecution of Bush Administration officials. While some worry that without legal consequences there will be no effective deterrence for the repetition of future transgressions of justice committed at the highest levels of government, others echo Obama’s seemingly reluctant stance on launching an investigation into allegations of criminal wrongdoing by former President Bush, Vice President Cheney, Secretary Rumsfeld, and members of the Office of Legal Counsel. Indeed, even some of the Bush Administration’s harshest critics suggest that we should avoid such confrontations, that the price of political division is too high. Measured or partisan, scholarly or journalistic, clearly the debate about accountability for the alleged crimes of the Bush Administration will continue for some time. Using this debate as its jumping off point, When Governments Break the Law takes an interdisciplinary approach to the legal challenges posed by the criminal wrongdoing of governments. But this book is not an indictment of the Bush Administration; rather, the contributors take distinct positions for and against the proposition, offering revealing reasons and illuminating alternatives. The contributors do not ask the substantive question of whether any Bush Administration officials, in fact, violated the law, but rather the procedural, legal, political, and cultural questions of what it would mean either to pursue criminal prosecutions or to refuse to do so. By presuming that officials could be prosecuted, these essays address whether they should. When Governments Break the Law provides a valuable and timely commentary on what is likely to be an ongoing process of understanding the relationship between politics and the rule of law in times of crisis. Contributors: Claire Finkelstein, Lisa Hajjar, Daniel Herwitz, Stephen Holmes, Paul Horwitz, Nasser Hussain, Austin Sarat, and Stephen I. Vladeck.

Survival under Dictatorships

Survival under Dictatorships PDF Author: László Borhi
Publisher: Central European University Press
ISBN: 9633867347
Category : History
Languages : en
Pages : 417

Book Description
A complex array of individual responses to the abuse of power by the state is represented in this book in three horrific episodes in the history of East-Central Europe. The three events followed each other within a span of about ten years: the deportation and murder of Hungarian Jews in Nazi death and labor camps; the Arrow Cross terrorist rule in Budapest; and finally the Stalinist terror in Hungary and East-Central Europe. Through the prism of survival, László Borhi explores the relationship between the individual and power, attempting to understand the mechanism of oppression and terror produced by arbitrary, unbridled power through the experience of normal people. Despite the obvious peculiarities of time and place, the Hungarian cases convey universal lessons about the Holocaust, Nazism, and Stalinism. In the author's conception, the National Socialist and Stalinist experiences are linked on several levels. Both regimes defended their visions of the future against social groups whom they saw as implacable enemies of those visions, and who therefore had to be destroyed for sake of social perfection. Furthermore, the social practices of National Socialism were passed on. And although Stalinism was imposed by a foreign power, some of the survival skills for coping with it were rehearsed under the previous hellish experience.
