It is tho treatise on ailments, which naturally precedes the one on their remedies. The nomenclature of offences, which is generally accepted, is not merely incomplete: it is absolutely misleading. Unless we begin by reforming this nomenclature, we shall be driven to leave the science in the state of obscurity in which we found it. What is meant by an 'offence'? The meaning of the word varies according to the subject under discussion. If we are concerned with a system of laws already established, it is an offence to do any act which the legislature has prohibited, whether for a good reason or a bad one.
