This report describes the main conclusions in relation to a series of 10 audits carried out in Member States during 2016, with the objective of evaluating the systems put in place to implement Article 4(6), on audits of competent authorities, of Regulation (EC) No 882/2004 of the European Parliament and of the Council. It was found that those competent authorities that had effectively implemented audits of official controls could demonstrate that their audit process contributed to ensuring the quality, and improving the consistency and effectiveness of official controls, provided that there was strong management commitment to the follow-up of audit recommendations. Some challenges remain in ensuring that audit arrangements are optimised to provide credible, reliable results that have a positive impact on the effectiveness and consistency of official controls. In particular some competent authorities had not yet fully addressed the requirements for independent scrutiny of the audit process and effective follow-up of audit results.

Furthermore, this analysis puts a focal point on the impact of the audit authorities' work on the assurance level of the EU’s spending in the Cohesion Policy. The European Union (EU) is committed to creating more and better jobs and a socially inclusive society. In this sense, EU cohesion policy plays a key role, as it aims to reduce development disparities between countries and regions, restructure declining industrial areas and encourage cross‐border, transnational and interregional cooperation in the EU in order to strengthening economic, social and territorial cohesion. The budget for this policy field has developed steadily and represents meanwhile more than one third of appropriations for the current multiannual financial framework. It is therefore the EU’s main investment policy. In order to achieve Cohesion Policy’s objectives and to ensure high impact for limited funds, a proper and effective management and control system is vital. Cohesion Policy is implemented under shared management, which means that responsibility for implementing the policy and the related funds, including control activities, is shared between the European Commission and the Member States. For the 2007-2013 programming period, a formal three-level control structure was introduced at national level for the first time, with the audit authority as the first “independent” audit layer. In a multi-level governance system, and based on the single-audit concept, audit authorities act as cornerstones of the overall assurance process by providing the European Commission with assurance as to the effective functioning of the management systems and internal controls for operational programmes – and thus the legality and regularity – of the expenditure certified by the Member State to the Commission. Together with other structural reforms, the formalisation of the internal control structure with a clear separation of functions and greater independence for management and control bodies is regarded as a material contribution towards a more robust governance system in relation to the audit of Cohesion expenditure.

This report presents the key results of eight audits carried out by the European Commission's Directorate for Health and Food Audits and Analysis in 2018-2019 that focused on how European Union (EU) Member States were implementing official controls on hygiene, traceability and trade of processed animal proteins (PAP), which are derived from category 3 animal by-products (ABP), and are authorised for use in certain types of animal feed, mainly for production of petfood and recently also for aquaculture feed. While in the EU there are prohibitions in place concerning the feeding to farmed animals of certain proteins derived from animals (so called 'feed ban'), a discussion is ongoing with a view to authorise certain PAP for production of pig and poultry feed in 2021. This series of audits examined how competent authorities have set up their official control systems and how effectively inspectors implement their checks to ensure that business operators are complying with the requirements concerning production, placing on the market and trade of PAP, including export to third countries.
