Law and Labour Market Regulation in East Asia
Author: Sean Cooney
Publisher: Routledge
ISBN: 113459755X
Category : Political Science
Languages : en
Pages : 322
Book Description
This edited collection examines the labour laws of seven industrializing East Asian societies - China, Indonesia, Malaysia, South Korea, Taiwan, the Philippines and Vietnam - and discusses the variation in their impact across the whole region. Leading scholars from each country consider both laws pertaining to working conditions and industrial relations, and those that regulate the labour market as a whole. Legislation concerning migrant labour, gender equality, employment creation and skills formation is also examined. Adopting their own distinct theoretical perspectives, the authors trace the historical development of labour regulation and reveal that most countries in the region now have quite extensive frameworks. This book will be particularly useful to people interested in the place of labour law, and law in general, in contemporary East Asian societies.

Managing Marital Disputes in Malaysia
Author: Sven Cederoth Cederroth
Publisher: Routledge
ISBN: 1136105220
Category : Social Science
Languages : en
Pages : 264
Book Description
A trend found in many Islamic societies in recent years has been the increasing regulation of family life by Islamic law and a corresponding move away from customary law and informal conflict resolution procedures. The situation in Malaysia, particularly in urban Malay society, is no exception here. Several studies already exist of the nature and extent of Malaysia's Islamic judicial system but the general tendency has been to ignore the actual operation of the syariah courts and related institutions. This study addresses this need with an in-depth analysis of the key area of intra-family conflict and demonstrates that, although formally the counsellor, kadi and judge have defined roles for conflict resolution, in practice much flexibility is evident in the use of consultation, conciliation, mediation, arbitration and adjudication techniques. This study will be of special interest to legal anthropologists and those scholars interested in the increasing application of Islamic law in many different countries.

Interactive Conflict Resolution
Author: Ronald J. Fisher
Publisher: Syracuse University Press
ISBN: 9780815627159
Category : Political Science
Languages : en
Pages : 320
Book Description
Interactive Conflict Resolution is the first book to comprehensively examine this innovative technique for peacebuilding: impartial third parties—through facilitated dialogue and focused analysis—bring together unofficial representatives of groups or nations engaged in protracted, violent conflict. Ronald J. Fisher discusses the works of major theorists as they have applied this technique to situations in Israel-Palestine, Northern Ireland, India-Pakistan, and Cyprus, among others. He describes various methods, including intercommunal dialogue, interactive problem solving, third-party consultation, and the psychodynamic approach. Comprehensive in scope, Interactive Conflict Resolution also explores how this technique can be used in conjunction with official diplomacy and other methods of third party negotiations, including mediation and prenegotiations. Fisher also addresses the critical areas which threaten the field, such as funding and institutionalization, and pinpoints the major challenges he sees in the years ahead.
