Book Description
Excerpt from A Treatise on the Law of Public Contracts In the leisure hours which fell to my lot in the occupancy of public office, I undertook to gather notes upon the law of Public Contracts. The practice of my profession had brought me in close contact with this phase of the law in representing contractors for subways, railroads, reservoirs, roads, and other public works. I appreciated from experience the difficulty of ascertaining the law affecting this subject and set to work in idle hours to codify it somewhat for my own benefit. As I proceeded with my work if occurred to me that no book had been written on the law of Public Contracts and so I entered upon the task of gathering together for the benefit of the profession all of the principles relating to the subject. I have done this largely in the hope that this work might prove a vade mecum for counsel to governmental bodies, municipal corporations, and public contractors. The method by which I proceeded, wherever this was possible, was to state the general principle affecting the particular subject in hand, then to state the subsidiary principles or exceptions to the rule, and lastly to illuminate these, when possible, by appropriate illustrations. In the examination of thousands of cases I have selected those best illustrating the text and have not attempted to weigh down the footnotes by excessive citation. With very few exceptions every case cited is a public contract case. The work does not include the subject of governmental or municipal bonds. ISBN:
Category : Law
Languages : en
Pages : 632

Book Description
Bring the expertise of America's foremost authority on contracts into your practice with this thoroughly updated three-volume set. Farnsworth on Contracts, Second Edition, is where doctrine meets practice. Busy practitioners count on Famsworth's proven ability to identify the essentials and omit extraneous material. His comprehensive coverage of the full range of contract law answers questions in hundreds of important areas, including: Good faith and fair dealing -- Precontractual liability -- Agreements to negotiate -- Vienna Convention on International Sales -- Contracts -- UNIDROIT principles -- Constitutional issues -- Settlement of disputed claims by check -- Options and rights of first refusal -- Employee handbooks -- Covenants not to compete -- Self-help measures. He illustrates how contemporary contract law has been shaped by both the Restatement (Second) of Contracts for -- which he served as Reporter -- and the Uniform Commercial Code. Easy access to specifics, new cases, new drafting tips, new references, and timesaving features like cross-referenced cases and marginal heads make this three-volume set a valuable resource for litigation, arbitration, and practice. Farnsworth on Contracts was always the most authoritative contracts treatise -- in its Second Edition, it is also the most up-to-date.

Treatise on the Commonwealth

Treatise on the Commonwealth PDF Author: Cicero
Publisher: Jazzybee Verlag
ISBN: 3849676250
Category : Philosophy
Languages : en
Pages : 96

Book Description
Cicero’s comprehensive treatise on the Commonwealth known as De Republica is a work whose direct and practical purpose was to arouse Roman citizens to the dangers which then threatened destruction to the liberties of their country. In appealing to his countrymen "to rise on stepping-stones of their dead selves to higher things," the inspired patriot did not hesitate to promise that all patriotic and philanthropic statesmen should not only be rewarded on earth by the approval of their own consciences and the applause of all good citizens, but by immortal glory in a realm beyond the grave.

Discourse on the Sciences and Arts

Discourse on the Sciences and Arts PDF Author: Jean-Jacques Rousseau
Publisher: Dartmouth College Press
ISBN:
Category : Literary Collections
Languages : en
Pages : 272

Book Description
Rousseau attacks the social and political effects of the dominant forms of scientific knowledge. Contains the entire First Discourse, contemporary attacks on it, Rousseau's replies to his critics, and his summary of the debate in his preface to Narcissus. A number of these texts have never before been available in English. The First Discourse and Polemics demonstrate the continued relevance of Rousseau's thought. Whereas his critics argue for correction of the excesses and corruptions of knowledge and the sciences as sufficient, Rousseau attacks the social and political effects of the dominant forms of scientific knowledge.
