Excerpt from A Treatise on Deeds As appears from the title page, the present work is founded upon the book published in 1885 by Sir Howard Elphinstone, Mr. Clark, and myself. When a new edition of that work was needed Mr. Clark had been appointed to his present position of Legal Adviser to the Board of Agriculture and Fisheries, and Sir Howard Elphinstone, who was fully engaged in bringing out some of his many works on Conveyancing, asked me to prepare the new edition. As soon as I took the old book in hand I found that it required more than merely re-editing, and I set about reconstructing the entire work. The greater part of the book has been entirely rewritten, all the authorities have been rearranged, and a large amount of additional matter has been incorporated; in fact, so extensive has been the reconstruction that Sir Howard Elphinstone very generously suggested (and Mr. Clark as generously con curred in the suggestion) that the revised book should appear under my name alone. Mr Ross, in his published lectures, led the way in a branch of legal practice, which had formerly been esteemed wholly mechanical, to a more intellectual view of the subject. By means of his inquiries a large store of information on the origin and history of our system of deeds, highly valuable to the lawyer, the student and the practical conveyancer, was collected and bequeathed to the profession. Although the shape of his work is now felt to be inconvenient in reference, its authority remains unimpaired. The Treatise of Mr Robert Bell, on the conveyance of land to a purchaser, is of a more practical nature, and has long been the most useful Manual in the library of the conveyancer. Aware of the large amount both of knowledge of principles and of practical experience which these learned persons brought to bear on their subject, I cannot but feel much diffidence, in offering to the profession a work on the same branch of practice. During that time I have examined the cases that have been decided since the first edition went to press, and have made such use of them as seemed best adapted to this edition. Some of them are simply affirmations of well-established principles of law, and their citation would serve no other purpose than as cumu lative authorities to lists already too numerous. Others in volve only questions of fact; others still are based upon special statutes, but many which state no new principle of law yet show its application to some novel condition of affairs, or make clear some rule on which courts have not agreed. Many new sections have been added to the text; others have been rewritten or enlarged, and ample additions have been made to the notes.
