Opinion surveys capture public perceptions. What are the key considerations when designing and implementing them in the APRM? At the recently-concluded Extraordinary APRM Forum Meeting of participating heads of state and government in Cotonou, Benin on 25-26 October 2008, Nigeria and Burkina Faso brought to nine the total number of countries "peer reviewed". All participating countries have had to struggle with the long, complex and sometimes confusing and intimidating Self-Assessment Questionnaire covering key issues in four thematic areas: democracy and political governance, economic governance, corporate governance, and socio-economic development. Answering these questionnaires risks becoming a highly technical exercise, accessible only to experts and elites. But the APRM also requires that the voices and views of ordinary citizens be heard and incorporated. One practice that is becoming standard is conducting nationally representative opinion surveys among the population.

This book presents a holistic perspective and analysis of democratic practice, processes, and governance in South Africa. It examines the development in the South African governing system and its response to the challenges of the crisis of governance under the influence of the African Peer Review Mechanism (APRM). While doing so, the book's central objective is to examine the progress of the South African government in strengthening democracy and political governance. Each of the contributions follows a similar structure and addresses the following thematic issues: (1) Assessment of the implementation of the core APRM-related programs; (2) Identification of areas of excellence and prognosis for further improvement; (3) Identification of the weak areas of each and how to make the future implementation better, (4) Identification areas to improve democracy and political governance. Situations of serious or massive violations of human rights are no longer purely of domestic concern, and sovereignty can no longer be an absolute shield for repressive governments in such circumstances. Based on this realization, the international community has recognized a responsibility to protect individuals in states where their governments are unable or unwilling to provide protection against the most serious violations. However, so far, only one intergovernmental organization, the African Union (AU), has explicitly made the right to intervene in a Member State part of its foundational text in Article 4(h) of its Constitutive Act. Although there have been cases of Article 4(h)-type interventions in Africa, the AU Assembly has not yet invoked Article 4(h) explicitly. This book brings together experts in the field to explore the potential application of Article 4(h), and the complexities that may explain its non-invocation so far. Although Article 4(h) is noble in purpose, its implementation faces several legal and policy challenges given that the use of force penetrates the principles of state sovereignty and non-intervention – the very cornerstones upon which the AU is founded. This book considers these issues, as well as the need to reconcile Article 4(h), in so far as it allows the AU to exercise military intervention to protect populations at risk of mass atrocities, with the provisions of the Charter of the United Nations. Drawing from the insights of law, political science, diplomacy and military strategy, the book offers a unique combination of multi-disciplinary expertise that harnesses the views of a diverse group of authors, focused on the legal, policy, and practical insights on the implementation of Article 4(h) and the responsibility to protect in Africa in order to provide concrete recommendations on how to end mass atrocities on the continent

Populations in Africa are vulnerable to both the direct and indirect adverse effects of climate change that are of human rights significance. The urgency for states in Africa to implement climate interventions while they face developmental challenges, however, raises questions of ‘justice’ or ‘fairness’ between the developed and the developing states. Consequently, interrogating how the human rights paradigm may respond to negative implications of climate change and its ‘fairness’ is important as states continue to engage with the climate change standard setting. This edited volume critically interrogates human rights paradigm as an intervention to secure climate change justice for vulnerable populations; analyses regional protection against human rights consequences of climate change; and assesses emerging interventions based on domestic regulatory frameworks on climate change in selected states in Africa.
